class action

Hello,

My husband and I were also scammed into purchasing a timeshare through Welk in 2014. We have been trying desperately to figure a way out. Can you tell me more about this lawsuit?

Where do I even begin? I took a timeshare visit with my fiance to this resort in December 2018 and met with a salesman by the name of Joseph A. He showed us around, talked about how it works, and then asked us if we would like to move forward.

I said no, because I didnt want to pay a $2,000 closing fee without doing my homework, and he said this deal was only good for 2 hours. That if I leave, by real estate law, he can't give me the same deal. We still said no. I told him I didnt want to spend the money and he then asked my fiance to apply for a credit card that is provided by Welk Resorts.

Keep in mind now, I already told him she does not work and has $0 income. He had her lie on the application stating she made over $80K a year as a Vet Technician, while telling her that they never check anyways so she will just get acceppted. Just as I suspected, she was denied. In fact, he came back to us with a phone from the resort stating that Barclays wanted to speak with her to verify her info. She was unable to provide info on her income so it was a no go.

He then came back saying he would do the closing for $1,000. I really didn't want to but he was practically shoving it down my throat at this time. I signed up. At this time I am now in a room with someone doing paperwork so fast I couldn't keep up. After we left I went home to do my homework and saw how god awful this decision was. I then posted a review on consumer affairs. After Welk replied to me, I called them twice the next week leaving messages to rescind my contract (I was told I had 7 days to cancel). Still with me???

Fast forward: It is now April 2019. I can't tell you how many different people I have called at this company to get a resolution. Each time they don't make notes and pass me on to someone else. HUTCH FARRELL calls me out of the blue around February. He tells me he is going to look into this and get back to me in about 48 hours. About a week goes by and I am blowing up his phone looking for him. He calls me back stating that he talked to his sales team and there is no record of any of this happening. DUH! You think the sales team is going to admit to it? Right.... Anyways, he then asks me to send him a copy of my wireless AT&T bill showing the dates I made the calls to them for the rescinding. I did so in PDF format. He said he would have his IT team look into this only to result in him saying a week later that he needed them to have a 2nd look. Well, another week goes by and the guy just doesn't answer my calls or emails. I called again today to the mainline to speak to someone else and a supervisor then said he would email Hutch so that he would contact me. Started to do some digging online and found this gem of HUTCH FARRELL: https://resorttrades.com/top-team-members-december-2016/ . Shows right on here that he has full authority to cancel any contracts for the company but he keeps acting like he needs to get approval. Funnier part about it, I have been emailing him every single day on the same thread looking for a response. I am saving it all for the next step which will be legal action. To date they have charged me $1,000 in closing fees, and about $336 a month to not use a thing. I didn't even use their bogus free giveaway for going to the timeshare seminar.

Welk Resorts and Hutch Farrell do not care about their customers at all. He is aware I have been posting bad reviews all over the internet and he just keeps putting me off.

STAY AWAY. RUN AWAY.

I purchased a vacation ownership from Welks Resort back in 2012 and after a divorce decided that i did not want to continue paying maintenance fees. I contacted the resort and was told that they did not have a buy back program and would not allow me to break my contract. After placing it for sell I was unable to sell it through a timeshare resell website. Welks sent me a document with information about a few companies that would potentially make offers to buy the ownership after I again contacted them to buyback the ownership. I placed the ownership for sale on Ebay and it finally sold. After signing documents and sending them to Welks I was contacted by a man named Nick which stated that Welks has the right to refuse sale to the buyer and that they have the first right to buy the ownership back for what I sold it on Ebay for. I then stated to Nick that I was told upon initally purchasing the ownership that I could sell the ownership to whomever I wanted and that I could also have the option to give the ownership to someone, including my family. Nick stated that all resorts have the "right of refusal" and that if the resort chose to takeback the ownership after the owner decides to gift the ownership to a family menber, then the resort could do so.

1. The original salesman lied regarding the sale of the ownership by myself.

2. The salesman lied regarding the option to gift the ownership to family members

3. I was not able to sell the ownership to a private party.

4. Welks Resort has taken the ownership from me and can now resell the ownership for the orignal purchase price of 10k, making a total of $19,500 off of the ownership, scamming buyers out of their right to sell what they have purchased. Welks and other resorts have certainly found out a legal way to scam unsuspecting victims out of their money in a legal manner. When will a class action lawsuit right this wrong?

Me and my husband were also lied, misled, scammed as well. This makes me sick to my stomach every month that I have to look at this bill. We also have been trying desperately to figure out what to do. Please help!!! Class action suit

I was offered Dodger tickets and a trip to Las Vegas if I would preview Welk resort in Escondido, CA. However a $40 deposit was required to make the reservation. I was then promised a refund of my $40 after I toured Welk resort. It sounded pretty good to me. I've been on several timeshare presentations before so i was not worried about the deposit. A week later I called Welk resort to make my reservation. They told me I had to called this number to make my reservation. I called at least 15 times morning, mid morning and evening. No one answered. When I called Welk resort back to report there was no one answering that number. I was informed "Well just hold on". RIPP OFF.

DO NOT SIGN UP FOR WELK RESORTS. LAWRENCE RESORTS IS A RIPP OFF.

To all owners of Welk who have noticed what a rip off and waste of money and time becoming an owner actually is. I will get stragiht to the point.

I bought points in 2013, after going to an "owners update" they told me my account was unbalanced and it would be smart to buy more points to balance it out. They said for $5,000 or so more, you can get 360,000 pionts every other year, but for only $5000 or so more, you can get 240,000 points every year!

They painted such a beautiful picture and obviously made more sense to buy more... They said its such a great investment and that if i ever wanted to sell they would buy back because it would cost so much that they wanted to make the profit...

These were all lies! Owning this timeshare does NOT give you a better deal, or better position. I asked for them to take it back and they bluntly said, "No! We do not have a buyback program" I'm now stuck with this big headache...

I'm hoping we can all come together and open a class action lawsuiit!
