TSALI NEZ GALLERY AND DIVA DIAMOND & JEWELS, LLC

30-DAY EXCHANGE POLICY IS A SHAM AND SHOP OWNERS WILL LIE TO MAKE THE SALE.

We were looking to replace a pair of earrings that matched a bracelet previously purchased. Unfortunately we found what we were looking for in the Tsali Nez Gallery, Inc. jewelry store.

After the salesman ran our charge card to make the purchase but before I had signed the invoice, we noticed a small chip in one of the inlayed stones on one earring. I pointed the defect out to the clerk and he said it was the nature of the inlay to have imperfections. I said that is funny because the other earring is perfect and all of the other 10+ stones in this earring are perfect. I asked if they would reduce the price by $20.00. The clerks said no, but that they had two other stores in the Santa Fe Plaza area that carried this earring and we could exchange the damaged earring at one of their other stores. The clerk added that actually one of their stores was right next door.

Note: The salesman took a picture of one of the earrings for reported inventory purposes.

Based on the 30-day Exchange Policy printed on their receipt along with the fact that their two other stores were also located in the Santa Fe Plaza, I agreed to make the purchase at this store since the transaction had already been processed on my charge card and it was just needing my signature.

We walked next door into their store (Diva Diamonds and Jewels, LLC) and were greeted by a young saleswoman. We asked the woman if they had earrings that looked like the ones my wife was now wearing. The saleswoman said yes they did and she moved to the display case where they were located. At this point the elderly saleswoman from the previous store, (Tsali Nez Gallery, Inc.) we had just left came into the rear of the store and shouted from the back of the store to the lady helping us at the front of the store that they had sold the earrings. The obviously unrelated young saleswomen helping us said, "No, they are right here". The elderly woman now moving toward the saleswoman that was helping us had her arms crossed in anger and in a stern voice again said loudly that they had sold those earrings.

I said are you kidding me and the old woman just shrugged her shoulders as to say, oh well.

The original salesman that I believe to be the older woman's son out right lied to us to complete the sale and the mother then would not honor their exchange policy of the damaged item within two minutes of the purchase much less than 30-days as posted and printed on their receipt..

I spoke with several other shop owners in the Santa Fe Plaza regarding our experience in the Tsali Nez Gallery and Diva Diamonds and Jewels. Three separate store owners on the Plaza stated they were aware of the poor reputation of the three businesses owned by Ala Shawabkeh (Tsali Nez Gallery, Inc., Diva Diamonds and Jewels, LLC and Divino Diamonds & Jewels, LLC).

One Plaza owner even stated and I quote, "The three Jordanian owned jewelry stores on the Plaza do not have a good reputation". In addition, further research indicates that the Nez Gallery store is supposedly "managed" by the Indian artisans (not owned) although no Native American Indians were at either of locations we visited.

It is sad that this dishonest and disreputable owner and employees are allowed to be a part of the New Mexico, Santa Fe Plaza heritage.
