The Public Trustee of Queensland Reviews

  • Oct 30, 2015

The Queensland Public Trustee is invariably appopinted by the kangaroo court (otherwise QCAT) to MIS-manage the financial affairs of anyone unfortunate enough to fall into its clutches. Any assets held 'in trust' by the Public Trustee is automatically assumed to be the property of the Public Trustee, to be squandered at will. Note particularly that despite official claims of accountability and transparency, the internal complaints review system is less than farcical, charges imposed are nothing short of extortionate, requests for financial statements are routinely ignored, there is no effective supervision by any external entity, and its blatantly obvious to anyone who has been involved with this utterly despicable organization that there is an incestuous relationship between the Public Trustee, the Adult Guardian and the kangaroo court.

One of the most despicable tricks inflicted (with the collusion of the Adult Guardian) on victims is arranging a shonky ACAT assessment with a view to to forcing victims out of their own home. If a victim is extremely fortunate they will be sent to a cheap and nasty nursing home, however many have been told to 'live under a bridge'. One particular unfortunate of indigenous extraction was told 'blackfellows shouldn't live in a house, you belong in Musgrave Park with the rest of your mob. Any proceeds from the sale of the victim's abode are either disposed of to some 'friend' of the Public Trustee or 'lost' in poor investments. A number of cases of kangaroo court intervention have resulted in seven figure estates being completely wiped out due to a combination of Public Trustee MIS-management and imposition of criminally excessive fees.

To add insult to injury, Public Trustee lawyers are protected against investigation by the Legal Services Commission. Since none of the normal watchdogs ie Legal Services Commission, Ombudsman, Crime and Corruption Commission, Attorney General (both state and federal) supposedly established to guard against bureaucratic malpractice are prepared to take any action, and the kangaroo court has been seen to turn a blind eye despite having been notified numerous times of the issues, the only possible conclusion that can be drawn is that the rot goes much deeper than simply the Public Trustee. For what its worth, one of the very few groups that have long been virtually untouchable in 21st century Australia is the judiciary. Given that the kangaroo court currently houses two Supreme Court judges, one is inclined to harbour suspicions regarding their part in this rort.

I'll finish this missive with a warning to anyone considering availing themselves of the Public Trustee offer to do their Will for free. Note particularly that the 'free' bit requires that the Public Trustee is appointed as executor, and when the never-ending delays and absolutely horrifying fees are taken into consideration, there is rarely any value left in the estate for distribution to beneficiaries. One should also remember that lawyers are not even distantly related to Father Christmas, and I'm not aware of any who run a charitable institution. Needless to say the typical lawyer fees are somewhat higher than one would expect from a tribe of brain surgeons. That said, Public Trustee lawyer fees are typically some 500% higher than the fees charged by any private lawyer, and as noted previously, they are not subject to censure by the Legal Services Commission, consequently there is absolutely nothing one can do about being ripped off.

There will be a number of sequels to this posting. Despite the considerable effort to which the Public Trustee, the kangaroo court, the judiciary generally, the executive government and the Attorney General have gone to sweep the issues under the carpet, a significant number of victims and carers have joined forces. A committee has been appointed to ensure the perpetuators are made fully accountable and further postings detailing progress will be made in due course.
