Contracted for deck construction in MAR 2018 for a summer 2018 Build.

Paid them the final 60% down in cash SEP 5th; agreement to complete deck NLT 1 OCT.

They didn’t begin constructing the frame until 10 OCT 2018.

Project was to take 2 weeks for the deck and another week for the patio cover.

After 8 weeks on site, the deck hadn't passed either of the first 2 regional building department inspections. (the frame didn't pass the 3rd inspection 30 days after they abandoned, either).

We identified damaged frame boards when they were dropped off in our driveway and not tended to for three weeks; contractor said they would replace them and never did. They constructed the frame with warped damaged materials and the crowns for each board are inconsistent where many are upside down.

Many of the frame boards were to be installed 12" On center (OC); we found the spacing to be various OC between 7" - 16".

This was the 1st breach.

The 2nd breach of contract came when most of the decking was installed, they didn't pre-drill or space the boards to manufacture specifications, and missed the frame boards in many locations, many of the deck screws are protruding from the now badly damaged frame boards and the spacing is visibly sporadically spaced.

They used a METAL edged snow shovel and removed the snow against the grain of the decking boards severely scratching and leaving gouges in many of the newly installed decking boards.

The 3rd breach came when they began painting and installing S4S cedar handrails when the contract called for redwood post and railings. We found a receipt for cedar on site after they abandoned. We told them the railings were to be redwood per contract, they packed up all their gear and left the site on 3 NOV 2018. Later on 3 NOV 2018, they sent us a new contract to align with the material breach and said they couldn't work on our project until we accepted terms of the new contract. The new contract didn’t reflect payments already made, is was back dated to March2018, it didn’t account for repairing or replacing any of the damage they had caused while on site. They threatened us that if we didn’t agree to their terms, their lawyer would tend to our dispute of the proposed contract, which, we did NOT sign.

When asked about redwood their reply was that is was "virtually impossible" to find in the USA. This is absolutely false as I found redwood readily available at 2 different stores both within 10 minutes of my house the same day he told us this. They had 7 months to this point to discuss any material changes and did not at any point in time. We specifically told him we wanted the deck constructed of redwood. We also sent an email on 17 SEP reminding them the invoice states redwood painted to desired color. They didn't mention anything about cedar at this point either.

They also assumed what color we wanted the deck painted and had to re-paint the trim once confronted.

We procured legal counsel on 9 NOV 2018 after they had failed to have open dialog about why they couldn't finish the contract as it was.

The owner and only licensed contractor in this company has NEVER visited the project or my home to verify the damage. When we left an honest review on his Facebook, he attempted to slander my wife and harass her saying she attempted to commit adultery with him, a man she has never met. All of his accusation against my wife are untrue. We have the financial capability to pay for what is due, but do not feel we should have to pay for materials we didn't agree to, a deck constructed outside of the contractual specifications and the extensive damage to the new materials installed.

As of 28 DEC 2018, they refuse to return any portion of the money we gave them, even as we offered to sign an NDA and give them access to collect all materials from the site, to include all cedar procured by them for construction.
