We purchased a Simmons Beautyrest mattress from a Sleepy's store. Less than 1 year after the purchase, one side of the mattress sagged extensively and essentially became a deep depression in the mattress. We contacted Sleepy's, who mailed us a Self-Inspection Kit to measure the depression. First off, the "ruler" they sent to us, which required us to show that the depression was at least 1 1/2 inches deep, misrepresented the actual depth of the depression because the "ruler" showed 1 1/2 inches as actually being almost 2 inches deep when compared with an actual tape measure. In any event, our depression was deep enough, so we took all of the required photographs (approximately 25 photos) and uploaded on the website as directed.

We did not hear back from Sleepy's for approximately 3 months. They would not return phone calls, and the warranty subcontractor company they used would not return phone calls. Come to find out, they denied the warranty claim without ever notifying us, on the basis that the mattress was in an incorrectly sized frame. When I contacted Sleepy's to dispute that, as the photographs clearly showed that the queen mattress was in a queen frame, I discovered that only 5 or 6 of the approximately 25 photos were being used by Sleepy's and they had ignored the rest of the photos, thus justifying the denial of the warranty claim in their view. Finally, after re-sending all of the photos, they agreed to honor the warranty.

We selected a new mattress, but upon delivery, the delivery man used a flashlight to examine the mattress and found one dried dime-sized spot on the mattress and stated that the one spot voided the mattress warranty in its entirety. He went on to state that Sleepy's and Simmons will refuse any mattress that has any indication of a spot or stain on the mattress. From approximately 1 foot away, there are no visible spots or stains whatsoever. It is only if you take a flashlight to the mattress can you barely see a spot. I requested permission to spot clean it, and when I did, the spot was no longer visible. Still, he refused to take the mattress, admitting that they rarely take mattresses back for Sleepy's and Simmons in particular because they always screw the warranty holders on this basis. So now, I am stuck with my defective mattress, manufactured by Simmons and sold by Sleepy's, and have to essentially sleep in a hole until I can purchase a new one at my own cost.

Meanwhile, I am 6 months pregnant, and the depression in the mattress is causing back pain. Simmons tells me that cannot do anything because this is a Sleepy's warranty since they are the authorized dealer. I feel at this point my only recourse is to publicly tell this story, to encourage other purchasers to not avoid Sleepy's and Simmons, as it seems they will do anything to not honor their warranty for manufacturer's defects. We have purchased many mattresses from Sleepy's. The mattress we replaced we had owned for 14 years. After we had it delivered, we noticed it was sagging after just one month. Sleepy's sent an inspector out and had it replaced. The new mattress started to sag just as badly as the first one. When we complained, they routed us to Mattress Marshalls and they sent an inspection kit. After waiting two weeks plus, we persued them to find out that they referred us back to Sleepy's. Sleepy's said that the mattress sagged only an inch and that was not enough. I believe that the fact that it was sagging at all to be enough. I was willing to upgrade the mattress, but after all this nonsense I want my money back, and I want nothing to do with Sleepy's ever again. I guess it was just a bad deal.

Went into Sleepy's to buy a new box spring and mattress because the sale included

'free box spring', free delivery and free curb removal of old mattresses.

Informed the salesman of a $1500 price range. He showed me a set for $1779.99. With the box spring

removed,$301.54, the total was $1478.45. He then added the pillow, bedliner, frame and delivery charge.

The total charge should have been $1975.82. However, if you re-add the box spring charge of $301.54, the

total comes to $2277.36, the difference is $301.54, or charge of the box spring.

He also charged me $100. delivery charge. You can look at 'every' ad, which states: "no delivery charge with

purchase more than $599. Also, the delivery men did not not remove the old box spring and mattress, causing

me a charge at the refuse center. When I arrived home, I noticed he did not give me the final receipt, which

I had to call for and drive to the store. Did not notice all this until now, because I was too sick to deal with it.

ATTENTION ALL SLEEPY'S CUSTOMERS:

This is the clause in the warranty that they are using not to fulfill the warranty:

Mattresses or foundations displaying stains or soil that reasonably indicates the presence of potentially dangerous bodily fluids, blood borne pathogens or other substances that could cause injury.

They harbor on the words "stains or soil" and selectively choose to ignore the rest. The stain they claim, however, is nothing more than a mere light discoloration.

After going back and forth on the phone, an alleged manager named "Melissa" had the audacity to have me go back to Sleepy's to make a donation the Sleepy's Got Ya Fund.

So for now I have to sleep in a defective mattress, but it isn't over yet.

I can't tell you where to purchase your mattress but I would implore you to stay as far away from Sleepy's as you can.

I purchased the top of the line Beautyrest Ultimate xl single mattresses on 6/20/16 from a woman named Allison at the Wolf rd store in Albany. I paid over $8,000. for these two mattresses only. Supposedly it was a July 4th sale price. The woman kept calling someone at each line of the contreact. She did not kone her job. Her husband, so she said was a district manager. When the bed arrived , they were hard. Nothing like the cushy ones in the store. After 3 nights of no sleep, i called Sleepy's customer service . The woman could not have been ruder and said there was a no return policy and to go to Sleepy's and seek out another bed. Well, i bought the top of the line and live 2hrs from that store; so there really was no recourse.

I called Allison and that particular store many times. Oh, we are so sorry,they said .We'll get right back to you and try to help you out. Never happened.

Not until i published with Consumer Affairs did i ever hear from anyone, and then they were rude and condescending with the exception of a man named Andy who is a Mass. district manager. He was sympthetic but didn't offer any recourse.

Today, i went by the store and it is now called Mattress Firm. What a rip off this company is. I will either have to donate it to a non profit organization or try to sell. Not great options for the money outlayed. I personally think they should all be closed down. PUBLIC BEWARE!

Sleepys rips off people with their deceptive sales unless you know you don't want to send it back then you should not buy it they will not correspond with you after your purchase and they made my income twice what it is when they reported my income they are a very shady company

On black Labor Day 2015 I went to Sleepy's in Bayside NY store to purchase a mattress on sale. I had a list with me of the mattress I wanted to check. As soon as I walked in the salesman grab my list and started to show me a $3,000 mattress. I told him I am not looking to spend that much money and that I was looking to buy one from my list between $600 & $800. Reluctantly he showed me few of the ones on my list but I didn't like the support. He showed me one that had a good support so I decided to buy that one. The salesman told me it was a $1,800 regular price and last week was on sale for $950 and today is only $749. I liked the firmest of the mattress so I purchased it for delivery next day. Next day something told me to check the price on line because I didn't like the way the salesman rushed me in the store. I entered the model number and the sale price on the mattress was only $649 not the $749 that the salesman charged me. I call the store immediately and I was switch to the main office. The put me on hold for long time and finally I was told that the salesman made a mistake and they will refund the $100 to my credit card. I took about 2 weeks to get my refund after many phone calls to Sleepy's. The salesman in that store definitely didn't make a mistake he deliberately overcharged me so he can get a bigger commission and that is called RIP-OFF!!!! Stay away from Sleepy's Rip-off artists!!!!

My husband and I moved to Boston July last year (2015) and we bought a new mattress on Sleepys the Mattress Professionals (*** ************** ***, Cambridge) on August. My husband is doing his PhD in Physics at MIT and has herniated disc (which was under control since we do exercise constantly and before coming here his last acute pain was 2 years ago, when he detected it). We bought a firm mattress (Serta Firm) as it was more appropriate for him, and it costed 800 dollars but the vendor did a discount and it cost 600 dollars, with a 1-year warranty.

However, 3 months ago the mattress started sagging, and the mattress that was initially firm is now completely soft (the springs gave way and are sagging with the applied weight). We called them and they sent a kit for self-inspection from Mattress Marshals, we inspected it and they replied that the mattress was OK. According to the call center we spoke later on, the sag had to be at least 1.5 inch deep to be considered as nonstandard. Our mattress is only 9 months old, and any sagging in this small time period should already be considered nonstandard! A mattress that could sag 1.5 inch in 9 months shouldn’t be on sale under any circumstances. Also, this inspection is exclusively superficial and does not disclose problems in the inner bed frame (such as the springs) which could be easily verified by applying some pressure on the bed. Lastly, when we were doing the inspection, we had to remove the mattress from the frame to take pictures of the frame and we put the mattress against the wall. At that time, the mattress bended into a U shape due to its own weight. This reveals the poor quality of this mattress, since it can’t even support its own weight on the vertical.

My husband is having acute back pains again, and he already did more than 1 month of physiotherapy and has been to the doctors 3 times! The situation was so bad that he started sleeping on the floor and it relieved the pain. This shows that his back pain is actually related to the poor quality of the bed. Finally, I had a friend staying over this week, and after one night sleeping on the bed she told me that the mattress was so irregular close to the edges that she almost fell from it during the night.

We called there twice and last time (today at 9 am) the attendant Mayda laughed at us in the end! We were asking for a new mattress or a total refund, and their best offer was a discount on a new mattress, and they didn’t even specify the amount of discount they would give us. We spent an immense amount of time, energy and money on this matter, and the mattress is still covered by its warranty (imagine if it wasn’t). Now, we don’t want a bed from Sleepys ever again, we want at least our full money back.

We purchased a memory foam mattress in October 2013 which came with a 10 year warranty. Earlier this year, we began having problems with the mattress sagging in the center which causes us to roll toward one another so we contacted the store. We went through their 3rd party Mattress Marshall's meaurement process which included a kit (which is laughable) to determine defectivness. They determined through pictures that our claim wasn't valid. The mattress is stain free and has been used with the recommended cover since purchase.

We have contacted the store manager, district manager, and multiple people through 1-800-Sleepys. Although he was apologetic, store manager John said there is nothing they can do. They had no problems taking our $2,000 in exchange for a bed with a BS 10 year warranty that doesn't exist. We have called the customer service number and spoke with numerous people who always seem to pass us on to "someone who can help" us. These "helpful" people request that we send pictures and assure us that we will receive a call back by a certain day (3 different times now); which never happens. Everyone apologizes but hasn't done a thing to rectify this matter; purely lipservice. We have spoken with Megan and Daniel, emailed Fred Montenegro, Kim Zalaya, Kim's boss Grace Hough, and another girl Chanel Rousseau. Not one returned phone call or email from any of these people.

Neither of us had back problems and now visit a chiropractor on a weekly basis. Beyond disgusted that after 6 months of this there is still no resolve. Sleepy's does nothing to back the junk they sell with bogus warranties. It was less than 2 years into this 10 year warranty!? From everything I have read they have been getting away with this throughout the nation so I doubt we'll ever see any cent of our $2,000+ again. Being a military family we will be sure to spread the word so that no one we come in contact with will face the same hassle.

Went back and forth on a warranty claim. Sleepys invoked the "mattress marshalls"

Went back and forth with them. Finally get warranty approved. Then a truck driver decides mattress has a stain.

I disagree. Truck driver produces a picture. i don't agree. several deliery attempts. After going back and forth repeatedly, a district manager calls and offers me a "discount" less than half what the warranty claim would be.

We cancelled the order and will buy the exact same mattress from PC Richards for less.

I bought a Tempurpedic mattress from Sleepy's. I specifically asked if the mattress gave off a smell. The salesman told me that it did absolutely no such thing. At the time of the order, the salesman told me that I could get a refund if I was not pleased, no questions asked. I placed my order and the mattress was delivered.

I slept on the mattress the first night. I got up the next morning very dizzy. I stopped myself from falling by sitting on the floor. Then I noticed a rash on my face. The mattress smells so bad that I have had the windows open in my house for 6 days, and I cannot get rid of the smell. My entire house has such a smell that I have been sleeping at a friend's house.

I finally called Sleepy's and they said that they can only replace the mattress, and will not refund. Needless to say, I do not want to do business with this company and I'll probably have to bring about a lawsuit to get my refund of $2500.

Do not buy from this company. Their salesman are liars and try to get the sale and give you a used mattress. They try to tell you that extra items comes with your mattress are free and lie after you have purchased it and never give it to you. I purchased a mattress which had stains on it when I received it. Then come to find out that there was an extra charge on my credit card that was not part of the receipt. Then they tell you that you get .99 cent sheets for free and they will send them to you and never do. When I called them they said it was never on your order and that they would not return mattress that they are all new. Will never buy here again.

I bought a queen size Mattress in march 2015, 1t price was 2900 i paid 1269.00 downand finance the rest with progressive leasing. The sales man. set it all and only disclosed the interest was high, unfortunately, my high interest thought was 18- 20 percent, not the 60 to 70 percent interest that i am experiencing. I am a Disabled veteran and feel taken advantaged of, I paid 315.00 amonth for 7 months and had been surprized when i saw the 7th payment leave my account. I found a phone number 877-898-1970 and choose to call and inquire about my balance, 10-28-15 and was told 913.51 which I did not have availible and then I called them today 10-29-15 and found I needed 1013.00 to pay it off. Please this is insane and I believe illegal, What should I do, Thank You

Sleepy's has the worst customer service ever. Everytime I called customer service each one of them gave me a different policy. I bought a Tempur-Pedic bed from Sleepy's in Ellicott City and I wanted to return it because my body didn't like it. I went to the store in Hanover because that's where I moved. They said you can not do a return you have to exchange it. Then I called customer service they said the same exact thing no returns. I went back to the Ellicott City store they said the same thing. So I did an exhange with another mattress which was delivered defective. The delivery guys said sleep on it the bumps will go away. Well it didn't. I called Customer service the 30 day exchange period was just over so I had to do an inspection and was qualified for an exchange. The customer service representitave said go to the store and pick any bed you like I asked specifically if I could choose any bed and they said yes. I go back to the Hanover store they said I have to pick a bed with equal or lesser value. So I call customer service once again they said well you had an option to exchange or RETURN the Tempur-Pedic but you chose to exchange. WHAT!!!! I had a chance to returnnnn when 2 of theirs stores (Hanover and Ellicott City) plus customer service said Sleppy policy has no returns on Tempur-Pedic. I go back to the sales guy who sold us the mattress in ellicott city he still says we dont do returns and we work seperately from customer service. I don't understand how the same company can have different policies. From my experience I noticed that they change their policy's each time so Sleepy's always wins not the customer. They lie and want your money and don't care about customer satisfaction. I should've done more research about this company. They are bunch of liars stay away from Sleepy's and save your money and time. I have a lot more but want to keep this short. I talked to the manager she just says sorry. I told her about this bad review she didn't even care. I guess this is how Sleepy's grew as a company. They absolutely don't care about the customer.

I purchased the mattress on may 16 2014. started to notice sagging and a hump across the middle. i talked to a sales lady, donna, august 14 2015 and she said i have a claim as the company carolina mattress guild went out of business and has had other complaints.she called customer service and i was told i had to go thru a 3rd party called mattress marshals! ok, so icalled and they told me they were sending a kit to test the sag. that took almost 2 weeks. when i got it i had to take pictures and send them back to them via thier website. i do not have the knowledge or means to do that so i went back to sleepys and told donna what happened. she called customer service and the said they would send someone to my home and that they would be calling 5-7 days. no calls. went bato sleeps and doona called customer service again and she was told they had my address at the time of purchase. ok, so i gave them my new address again and she said she updated the information and i would hear from them in 5-7 days. on the 7th day i got a call from mattress marshalls and the gentleman said he would be at my house 10/2/15. i made sure he had my right adress because i had to give him directions. he never showed or called. so i went back to sleeps and told donn what happened and she called customer service and i was told the would have someone call me again that donna had not updated my information correctly. well when mattress marchalls called the sure had it right. so i call customer service myself very upset and all the would say was sorry, we deal with a 3rd party and thank you. i call donna then and she gave me the president of the companys email address which i have not been able to get thru.instead i got your web site. saturday evenint the 10th of oct i recieved a call from customer service. peter kept saying how sorry he was about all the problems but he assured me i would hear from mattress marshall mon or tues. guess what. nothing. i am really disappointed in sleepys but i also dont understand why they do not honor thier warrenty or product. i am not done here but i do hope you can help. i am going to continue to locate the president david acker and will be in touch with the local media.

We purchased a $3500.00 top of the line box spring and pillow top mattress from sleepy' Mattress 18 - months ago. We both noticed we are waking up with sore backs. I looked at the mattres while my wife was sleeping and couldn't believe how much the mattress was sagging.

we went to our local sleepy's Mattress company the salesman advise us to call the mattres warranty company to get a mattress warrants kit. They sent it out to us what a joke that is. You have to run a string line across the mattres and take photos of the sagging mattres. I called and explain that we have a plillow top mattress and when you are not laying on it you can hardly see any sagging but when you lay on it you get a 6"-8" sag and mind you my wife is only 140 pounds and I am 180 pounds.

i sent the pictures as per kit instructions and as I expected they said the mattress is fine. I told the person on the phone how can you see a sag in a pillow Top mattress. He said you can call sealy mattres and take it up to them. I told him I purchased the Mattress from sleepy's and it is not my responabilty to call the manufacture. this warranty is bogus they do not stand behind their product. Now we have to go out and buy a new Mattress.

We are having a 4- bedroom townhouse built at the NJ shore and will not purchase any mattress from sleepy's
