Ethics commission fines former arts commission community investments director barbara mumby $20,000 for violating ethics laws.

At its monthly public meeting friday, the san francisco ethics commission unanimously approved a stipulated agreement fining barbara mumby, former director of community investments at the san francisco arts commission, $20,000 for four counts of violating city ethics laws.

In the proposed stipulation, decision, and order adopted by the commission, mumby acknowledged responsibility and agreed to pay a monetary penalty for receiving a gift from a source doing business with her department, failing to file public disclosures of her personal financial interests, improperly providing selective assistance to a person competing for a city contract, and furnishing fraudulent evidence and failing to cooperate with an investigation.

As authorized by the city charter, the resolution of violations through a public stipulated agreement enables respondents and the ethics commission to resolve enforcement matters without the need for a hearing on the merits. The commission is authorized to assess a monetary penalty of up to $5,000 or three times the amount of the amount improperly received, expended, or reported for each violation.

Commission chair yvonne lee highlighted the severity of mumby’s actions and noted the variety of laws under the ethics commission’s jurisdiction that were violated. Chair lee commended ethics commission investigators for securing the maximum penalty amount for each count of a violation.

As detailed in the settlement agreement, in the matter of barbara mumby Sfec case no. 1920-051), while community investments director in 2018, mumby authored the majority of a friend’s grant proposal for an individual artist commission Iac) grant application. Mumby then took steps to advance that application through the screening process despite her personal involvement in drafting the application and knowledge that the grantee did not meet the eligibility criteria.

As such, mumby knowingly conferred a competitive advantage on a proposer who was competing for a city grant in violation of the city’s prohibition on selective assistance. In resolving this count, the commission fined mumby $5,000.

Mumby accepted reimbursements from the applicant that sought the iac grant from the arts department to cover part of the costs of an august 2019 trip to hawaii for herself, her dependent child, and others, including the grantee. For accepting a prohibited gift from a restricted source that was seeking to do business with her department, mumby agreed to pay $5,000.

The commission also fined mumby $5,000 for failing to file required public disclosures of her reportable financial interests within 30 days of her resignation from city service in january 2020.

Lastly, the commission fined mumby $5,000 for making false statements to investigators, providing fraudulent documents to conceal her conduct that violated city law, and intentionally misrepresenting facts to the city attorney’s office during their investigation. In so doing, mumby violated the city’s requirement that city officials and employees cooperate and assist with an investigation.

ANNE TRICKEY, got the job at the SFAC because she is the niece of the former Director of Cultural Affairs- Tom DeCaigney. She could do no wrong. Just out of college, low on experience and high on self worth-she made false claims when called into the Sunshine Task Force over failure to turn over requested documents. There were multiple requesters and each time, she lied to the Task Force.

TRICKEY, then retaliated on each request or by filing false SFPD police reports against the requestor. TRICKEY, is near sighted and ran into someone. She then claimed she was assaulted. She claimed a homeless man was employed by the SFAC and used him to server paperwork. She lied in court and. AT THE CCSF TAXPAYERS EXPENSE used the SF City Attorney's Office as her personal lawyer.

TRICKEY, filed a false copyright infringement case against another artist and lost the case. She wanted a fee waiver for the $400 filing fee, even though she claimed she made $100,000 a year.

Fama thiam is an african female who sells mass produced jewlery on 4th and market street. For the past 25 years, people have filing complaints with the ccsf over the fact that she doesn't make any of the jewlery; she has unliscensed workers and she sets up other displays of sunglasses and clothing. The san francisco arts commission and anne trickey have never responded to any complants and never go out into the street to investigate. This is a violation of the sf charter. Fama thiam, is rude and abusive.

Anne Trickey is a low level staffer at the San Francisco Arts Commission. She didn't want to be bothered with the Street Artist program, so she spent $100,000 of SF taxpayer money for safety of street artists on weekends.

This man is that security. He spends more time sleeping than working. Emails to the SFAC go unanswered.

PATTERSON WAS ON VACATION (AS USUAL) AND AFTER A FEW HOURS I RECIEVED 50 OF THE SAME EMAIL FROM SOMEONE WHO DID NOT SIGN THEIR NAME OR GIVE ANY SORT OF CONTACT INFORMATION. THEY USE THE NEXT REQUEST SYSTEM. I ASKED FOR THE NAME OF THE PERSON AND THEIR PHONE NUMBER BUT THE REQUEST WAS CLOSED WITHIN 1 MINUTE AFTER SENDING THE SAME EMAIL I SENT TO THEM.

THIS IS NORMAL FOR VARIOUS EMPLOYEES THERE. THEY REFUSE TO WALK ACROSS THE STREET TO SF CITY HALL FOR SUNSHINE MEETINGS AND MAKE THE REQUESTOR SIT THERE FOR HOURS. THE SF ARTS COMMISSION HAS OVER 31 ORDERS ISSUED AGAINST THEM BY THE SF BOARD OF SUPERVISORS AND IT SEEMS THEY HAVE NO INTENTION AT ALL OF CHANGING THE WAY THEY DO THINGS.

Anne Trickey of the San Francisco Arts Commission, is the child of a retired Appeals Justice in Washington State and a retired Public Defender in Seattle. As such, she should know how to draft a complaint and conform to the Federal Rules of Court. Not so. Trickey did her typical slander and personal attacks on someone she doesn't know. Since her complaint didn't conform to the Rules of Court and lacked jurisdiction-it was an agnry rant that made no sense. Trickey wanted a fee waiver and gave her income. Since both her and her spouse make over $200,000 a year-her fee waiver was denied. She then changed from a magistrate judge to a district judge and failed to pay the $400 filing fee.

The defendant was not personally served but found out about it through a public record search. Trickey filed a proof of service with the court and by filing that-she lied on that document-a Federal offense.

There is no oversight at the San Francisco Arts Commission. Neither Tom DeCaigney or JD Beltran cared about this and there was no response to either emails or phone calls.

Anne Trickey should be fired. She is a total head case with a chip on her shoulder who doesn't know what she is doing.

THE 3 PEOPLE EMPLOYED BY MJMM MANAGEMENT ONLY DEAL WITH THE RUNNING OF THE LOTTERY (WHICH IS DONE ON LINE) AND PARKING. THEY DO NOT CARE ABOUT THE INFLUE OF MASS PRODUCED GOODS OR COPYING.

THE SF CHARTER MANDATES THAT THE PROGRAM DIRECTOR ( TRICKEY) RESPOND TO COMPLAINTS AND GO OUT INTO THE STREET TO INSPECT. SHE HAS NEVER DONE THAT AND HATES STREET ARTISTS. THERE WAS NEVER AN ITEM ON ANY AGENDA THAT MENTIONS THE ALLOCATION OF $160.000 OF SF TAXYPAYER FUNDS TO DO TRICKEY'S JOB.

THE PUBLIC WAS NEVER MADE AWARE OF THIS AND SHE CONTINUES TO MISREPRESENT TO THE PUBLIC AND THOSE STREET ARTISTS WHO PAY $1.000 PER YEAR IN FEES THAT SHE IS WORKING TO IMPROVE THE PROGRAM.

THE TRUTH IS A STATE LAW IN CALIFORNIA THAT DECRIMINALIZES PEDDLING IN THE STREET WITHOUT A PERMIT. TRICKEY HAS NOT TOLD ANYONE ABOUT THIS AND WHEN ASKED WHY THE STAND NEXT DOOR IS A FEAL MARKET WITHOUT ANY PERMIT-TRICKEYS IGNORES THE QUESTION.

THERE IS A MASS EXODUS OF ARTISTS FROM SAN FRANCISCO AND IT IS EASY TO SEE WHY. IT IS TOO EXPENSIVE AND THE SAN FRANCISCO ARTS COMMISSION-ANNE TRICKEY DOESNOTHING BUT TAKE PERMIT FEES AND DOES NOTHING.

DURING A PUBLIC RECORD SEARCH, AN ARTIST IN SAN FRANCISCO NOTICED A FILING AGAINST THEM. TRICKEY FILED A COPYRIGHT INFORNGEMENT CASE IN US DISTRICT COURT-SAN FRANCISCO. HER CLAIM WAS THAT TRICKEY'S ORIGINAL ARTWORK WAS STOLEN AND SOLD BY THE DEFENDANT. TRICKEY NEVER MENTIONED THE IMAGE. TRICKEY'S FEE WAIVER WAS DENIED. TRHICKEY THEN MOVED FROM A MAGISTRATE JUDGE TO A DISTRICT JUDGE. SHE LIED IN HER FEDERAL FILING CLAIMING THE DEFENDANT WAS SERVED. TRICKEY FAILED TO FOLLOW FEDERAL RULES OF COURT AND HER CLAIM WAS DISMISSED.

WHEN TOM DECAIGNY; JD BELTRAN AND LAUREN CURRY WERE CONTACTED WITH THIS INFORMATION-NONE RESPONDED. WHILE IT IS CLEAR THAT ANNE TRICKEY CAN DO WHAT EVER SHE WANTS AT THE SAN FRANCISCO ARTS COMMISSION, THERE IS NO OVERSIGHT IN THAT DEPARTMENT. DECAIGNY WAS AWARE OF THE FILING AND CHOSE TO DO NOTHING.

THERE NEEDS TO BE A FULL INVESTIGATION INTO THE DAY-TO-DAY PRACTICES OF THE EMPLOYEES OF THE SAN FRANCISCO ARTS COMMISSION. WITH 41 ORDERS OF DETERMANATION ISSUED AGAINST VARIOUS STAFFERS THERE BY THE SF BOARD OF SUPERVISORS-THEY HAVE A HUGE TRANSPARENCY PROBLEM AND CONSTANTLY INVENT SISTUATIONS AT THE SF TAXPAYERS EXPENSE.

TRICKEY RAN UP ON A STREET ARTIST NOT IN THE STREET ARTIST PROGRAM AND NOT UNDER THEIR JURISDICTION ON JUNE 15, 2018 AT 8AM. SHE FAKED AN ASSULT BY TRYING TO PREVOKE THE ARTIST. THE ARTIST TAPED HER FROM HER CELL PHONE. TRICKEY THEN FILED A FALSE ASSAULT REPORT. IT WAS DISMISSED. SOME FOUR MONTHS LATER, SHE CLAIMED IN A CIVIL CASE THAT SHE WAS ASSAULTED. TRICKEY THEN FILED A CIVIL CASE IN FEDERAL COURT AGAINST THE SAME ARTIST. ONCE AGAIN, SHE USED THE FAKE ASSAULT AS A BASIS FOR HER COPYRIGHT FILING. SINCE TRICKEY HAS NEVER DONE A DOMAIN SEARCH ON THE WEB SITE: SANFRANCISCOARTSCOMMISSION.COM-THIS IS ANOTHER MERITLESS FILING.

TRICKEY HAS 41 ORDERS OF DETERMANATION ISSUED AGAINST HER BY THE SF BOARD OF SUPERVISORS. SHE IS UNABLE TO TAKE DIRECTION IN RUNNING A PUBLIC MEETING. SHE CONTINUES TO MAKE THE SAME MISTAKES AND TRIES TO TAKE DOWN ANY WEB SITE THAT MENTIONS THIS INFORMAITON.

SHE REVOKED THE STREET ARTIST PERMIT OF JEFF POTTER. POTTER WALKED THRUGH A DOORWAY AT THE SAME TIME AS TRICKEY. HE WAS CHARGED WITH SEXUAL ASSAULT. IT IS A CONFLICT OF INTEREST FOR TRICKEY TO TESTIFY AS SHE WAS THE ALLEDGED VICTIM AND RAN THE MEETING.

BARBARA MUMBY, ANOTHER STAFFER AT THE SFAC-THREIGHTNED A MEMBER OF THE PUBLIC IN THE HALLWAY OF SF CITY HALL JUST AFTER A HEARING CONCERING THE PIONEER MONUMENT. SHE CLAIMED SHE WAS AN INVESTOGATOR WITH THE MANHATTAN DISTRICT ATTORNEY'S OFFICE. SHE REFUSED TO PRODUCE ID TO PROVE HER ALLEGATIONS AND THREIGHTNED THE ARTIST.

Both ANNE TRICKEY and BARBARA MUMBY have sent me annoying and threightning emails. They say that, "If I don’t address Trickey as Mx Trickey my street artist permit could be in jeopardy and this will be seen as a form of harassment”.

I don’t have a street artist permit. It was taken away illegally when Trickey claimed that, "I sexually assisted her” when I walked through a doorway at the same time.

The entire staff of the SF Arts Commission should be investigated and all staffers should be jailed for lying and backing each other up. Real sh*t show over there.

MUMBY refuses to turn over documents. I make reasonable requests for lists of inspections done on street artists stands made by staffers of the San Francisco Arts Commission. I don’t get any reports and am threightned via email that, "my permit could be in jeopardy for threightning her”.

I don’t have a permit and MUMBY cites government codes that have nothing to do with refusing to turn over documents. The street artist program is under the jurisdiction of the SF Arts Commission. The SF Charter mandates that inspections be conducted to insure compliance with the law.

The SF Arts Commission has not done any inspections in over two years. I have filed multiple complaints against FAMA THIAM, a street artist who has had a stand of mass produced jewelry for over 25 years. MUMBY, ignore the complaints and sends me threighting emails.

SHE LEAVES MESSAGES INVITING ME TO SAN FRANCISCO ARTS COMMISSION EVENTS. THIS HAS BEEN GOING ON FOR THE

PAST TWO YEARS.

SHE IS CONTACTING ME TO DONATE MONEY TO ONE OF HER AMERICAN INDIAN CAUSES. MUMBY

HAS BEEN RELENTLESSLY HARASSING ME. I HAVE CONTACTED SENIOR STAFF MEMBERS AND VARIOUS SF SUPERVISORS

ASKING THAT THIS STOP. I HAVE NEVER RECIEVED A RESPONSE FROM ANY OF THEM.

I sent an email to: [email protected] and [email protected] asking when the next executive meeting was taking place. I recieved an email from Mumby which says,”You must address Anne Trickey as Mx. Anne Trickey.

Otherwise, your street artist permit will be revoked.” She cited CA Gov. Codes 67.16’and 67.15. Both of the these codes pertain to the posting of meeting minutes and response times for document requests.

Howard ,Lazar has been ripping off the street artists of San Francisco for 42 years. He should be at the SFAC office 40 hours a week but has been there less than 20 for the past 42 years. He has another job as a janitor at the South End Rowing Club. How can a 72 year old have 2 40 hour a week jobs? Lazar lies constantly and wastes thousands of dollars of tax payer money defending his bogus claims. He has personally drive. The street artist program into the ground. He is a pathological lier and con artists.
