Beginning in August, my husband and I took several bids to replace our roof, which had been leaking for some time. We were hoping to have a replacement completed by the end of the year.

Jr. and Sr.'s was the lowest bid. His requested deposit was quite high and we were able to negotiate a lower deposit. However, we found that according to state law, both of his deposit requests were too high. According to Pennsylvania law, "If a contract is more than $5,000, the contractor cannot accept a deposit greater than one-third of the contract price, or one-third of the contract price plus the cost of special order materials."

Our contract stated that the work would be completed by the third week in October. He also stated that he would cover up leaking areas of our roof until the work would be done. He did come out to do this, when no one was home, but did not do it correctly and our roof continued to leak.

The autumn in Pennsylvania was extremely rainy. We understood this and that Jr./Sr. could not get out to replace our roof. I am fairly certain that they took on too many jobs and were unable to keep up with them due to the weather (and who knows what else). We continued to ask when they might be coming to replace our roof and kept getting put off with excuses, plus the leaks were never properly dealt with. Finally around November we were told they would not be able to do it before the end of the year because they cannot work if it is below 40 degrees. At this point we had no idea when they might come to do the job, if ever, and they still had our $.

We decided to contact another roofing company which came right out to give us an estimate and did the job within a month of our initial contact. In the meantime, we contacted Jr. Sr. to terminate our contract with them and requested the return of our deposit (minus anything they had spent remediating our roof leaks and/or restocking fees for materials already purchased). We were met with excuse after excuse. One of which was exactly the same as the other report - that he was in the middle of processing our refund when he had to be taken to the hospital. We see on his facebook page postings of other jobs he has completed, and we still have not seen our refund. The latest excuse is that Home Depot is supposedly giving us a refund for shingles that were purchased by Jr./Sr. on our behalf, and that Home Depot must be slow in issuing our refund. I have never heard of Home Depot refunding the home owner rather than the contractor who made the purchase - we are following up with Home Depot on this. Regardless, Jr./Sr. NEVER asked us the shingle color we wanted, nor scheduled the job, so we do not know how he could have ordered shingles for our roof in the first place.

We understand the issue of the weather. But the bottom line is that we paid for something that we did not receive. Jr./Sr. broke the contract by neither scheduling, beginning, nor completing our job before the agreed upon date, and giving us no indication or guarantee as to when it would ever be done. Being lied to and given excuses instead of honest answers just makes matters worse.

We have now filed complaints with the BBB and the Attorney General's Office.

I advise against giving this company any deposit. And learn from our mistake - never give a deposit that is more than 1/3 the contract price. Read the PA Home Improvement Consumer Protection Act before hiring any contractor.
