We had listed our home for sale and accepted an offer with a non refundable immediate release of $30,000. We were assured by Pat Phillips and Rodeo Realty that this deposit would be ours if they did NOT PERFORM by the closing date of escrow. The closing date came and went and Rodeo than obtained a per diem agreement to have them perform by a specificed date. When that date came and went and the buyers didn't perform I wanted to cancel the escrow. My attorney did go ahead and advise me NOT to cancel the escrow because RODEO REALTY, PAT PHILLPS, CARY HOFFMAN, SYD LEIBOVITCH and all ASSOCIATED PARTIES WITH RODEO REALTY failed to deliver a proper "Standard Of Care" I enlisted the help of an attorney who said that I could not cancel escrow without opening myself up to a lawsuit because Pay Phillips, Cary Hoffman, Syd Leibovitch and ALL ASSOCIATED PARTIES WITH RODEO REALTY had exposed us to being liable.

I did cancel my escrow and was forced to reinstate it as the other parties attorney said " their was no end date on the extension"

I also wanted to cancel the escrow because PAT PHILLIPS and Cary Hoffman did not disclose upfront that the buyer was acquiring the house using a 1031 exchange. THAT IS ILLEGAL in a residential transaction that Pat Phillips self admitted that the buyers were going to be living in the house. She said that really isn't an issue for you... but I knew that we were going ahead and knowingly let people commit an IRS Fraud. She said not to worry about it...

We finally ended up closing but against my will as I had a $30000 immediate release and being that they did not perform if the extension was written with a specific end date I could have canceled, kept the deposit and NOT PARTICIPATED IN A FRAUDULENT 1031 Exchange.

BEWARD THIS I AM SURE IS NOT A ONE TIME OCCURENCE and I am being forced to go ahead and sue and look at CLASS ACTION POSSIBILITIES AS I am sure Rodeo had done this before.

I attempted to settle but Rodeo thinks they are not wront and I was not exposed...
