I've live in Miraleste Canyon Estates town home for over 15 years...

While living here, I've suffered the loss of a mature shade tree on my porch and the bushes in front of my town home were hacked down in revenge to retaliate against me after I asked to have my name placed on the ballot for the previous elections...just a year ago.

After being verbally and physically assaulted in my own community, I thought I better try to stop this maniacal hypocritical tyranny. So, I decided to run for a position on the board of directors which was denied. My application to run for a position on the board of directors was denied.

Instead, I was issued $3,000 in fines, directly after, Virgil Magday physically threatened and verbally assaulted me in the parking while returning home and trying to park my car.

Magday became hostile towards me in the presence of the lead contractor for Simich Contractors when I asked him.

Where's the humanity in chopping down the trees at Pool#2 and filling in the planters with cement?" Naturally, it's nice to have natural shade to sit under while sitting near the pool...Yet, Mink Management and Magday don't seem to think that residents have any right to preserve their trees or their peace and tranquility.

Over the past three years, Virgil Magday hired Simich Contractors along with his brother in law's plumbing company, Stephen's Plumbing.

Virgil Magday, Mike Holguin, and Don Mink have allowed the illegally removal of our trees along with illegal hiring of friends and family that spent $670,000 in one year after hiring their friend, Mike Fore, as the plant manager...only to allow him to hire Los Gatos, Inc. to install a 10" extension on top of the fence at Pool#2...which has since fallen down and it's still in need of repair...The north side fencing on First St. is also rusted and falling over.

Unscrupuolusly, Mike Fore was allowed to hire Los Gatos, Inc. (tree service) without board approval and without getting three bids which lead to the residents being forced to pay $170,000 rather than $5,000...which is all that this poorly devised solution should've been allowed to charge...Our existing gate vendor, Marina Gate Co, offered Larry Wiggins a bid for less than $13,000 to not only extend the fence but replace the entire fence and install two new gates...Instead, we're left with a huge invoice but no voice of opposition to this corruption that not only embezzeled money but it harasses the residents with undeserved fines to hide their twenty year terrorizing Miraleste Canyon Estates property values and residents becaause they've hired maintenance crews to make archeitectural changes that don't meet the building codes...and the professional landscaping services of GS Brother's was discontinued after Magday, Holguin and Mink hired Magday's friends at an exorbitant cost of $350,000 per year rather than pay professional landscapers only $110,000 per year without having to pay worker's compensation benefits only to employ a dozen of Magday's friends to sit in the shade while collecting a paycheck whilw they hire another contractor to complete the work...Los Gatos, Inc. Meanwhile, these maintenance workers haven't upgraded our landscaping beyond using the leaf blower which has cost MCE approximately $2,000,000 over the past 7 years since these workers were illegally hired without community or board approval...

Mike Fore and Raul's Crew were hired in 2007-08 while I was a board member. Amazingly, the decision to hire these unqualified people came directly from Virgill Magday. However, he wasn't even on the board of directors while living apart from his wife. It was Mike Holguin that agreed to follow Magday's plan that wasn't agreed upon by the board. I was the board member that discovered Mike Fore had hired Los Gatos without board approval before he racked up $170,000...to extend the fencing....

I questioned the logic of why we tripled our labor costs only to employ Magday's friends only to reduce the quality of service...that was professionally being provided by GS Brothers...Then, the real reason became apparent as to why the hired Mike Fore...He was hired to not only embezzel money but he was offered a $7,000 severance check without being required to sign a waiver releasing MCE from further litigation which invited his friend to retain a lawyer and sue me on false claims of sexual harassment because I was the one that had realized his impropriety and retained a copy contract to make certain that it wouldn't automatically renew itself...Therefore, I exposed their embezzeling scam...During this one year of being forced to hire Mike Holguin and Virgil Magday's friends...Mink Management authorized $670,000 of expenses paid directly to Miker Fore and Raul's Crew as well as Los Gatos, Inc...without any benefit beyond a special assessment to pay for the contrived lawsuit that Magday intentionally orchestrated...while he slandered me in the MCE Newsletter with the malicious intentions of ruining my career as a public school teacher that I held for 17.5 years until Magday decided to use the MCE Newsletter to name me as the cause of his orchestrated plans to continue hiring his friends and family along with Leo Sec Security to harass the residents...to protect his 20 year reign over MCE...

Magday, Holguin and Mink don't notify the residents regarding the home owners meetings. Most recently, only one resident showed up in attendance at "the Meet the Candidates Night" because they're not posting visible signage to notify residents and they aren't passing out flyers to inform the residents...

Then, they'll issue residents a fine for passing out information to inform them about the upcoming meetings because MCE is being mismanaged to benefit the board members and everyone that the residents are forced to pay...only to uphold this 20 year tyranny that Don Mink turns a blind eye to...which is harassing the residents and reducing our property values because he ignores the unscrupulous behaviors of the board members...because they pay his salary as long as they stay in control of the board of directors while the quorum is allowed to hire two different law firms to support their election process...

However, when will the residents' money be used to hire an attorney that works for the residents to conduct a complete open book audit over the past 15 years to uncover the truth that Don Mink seems to remain financially unaware because he continues to allow these long standing corrupt board members to harass the residents and hire their friends only to allow them to sue the community and remain employed without a contrator's license as his weapon of distruction to distroy residents real estate values...because Raul's Crew is without any capacity to follow the building code as it relates to basic construction concepts that include hanging rain gutters vertically while knowing to use the required amount of exterior stucco, 7/8" thick...Instead, they make a mess with dripping paint everywhere and they mainly only blow the leaves from here to there without ever picking up the weeds or installing sprinklers which was the promise made by Magday when he forced the community to hire his friends after he illegally fired GS Brothers...without community approval which has caused MCE to spend an excessive amount on substandard results that have cost MCE $2,000,000 along with a contrived litigation of $150,000...because Magday, Holguin, and Mink are all winking at eachother.

Meanwhile, the tyranny of powers post security guards outside your townhome while Virgil Magday's friends chop down the bushes in front of your town home to expose your home to excessive sunlight from dawn till dusk...

I've been unrightfully issued $3,000 in fines and bullied by an unscruplous management that perpetuates a constant reign of terror over the MCE community...
