Last year on or about January 2016 I signed a contract for sale with Kendall Homes with Ms. Maria Cerda with a $1000.00 good faith deposit. Sometime in February a change order was signed to redraw the floor plan adding a covered patio. The original contract gave a date of December 2016 for completion. It became evident this date would ever become a reality as work had not begun around this time. We then set a new contract on or about July 2, 2017 with changes to the original plan adding square footage and changes to the master bath along with window changes and a finished patio. Completion on or about March 2017 and was asked for an additional $2000.00 at this time received by Kendall Homes. These funds were given in good faith that the new plans would be drawn up to specification.

Some time had passed when I finally was called in to review the plans. While perusing the new plans I noticed two items that were quite disturbing. One was where they completely removed one of the Master bath sinks and added a cabinet. The other was where they made the hallway going into the Master Bedroom much more narrow than it already was. I expressed my feelings to this regard to Maria and then asked for a copy of these plans for my file. I know Maria read the expression on my face when she said she was not allowed to give me a copy. I expressed my shock to this fact as it took me by surprise. Well if I paid for them, then they were certainly mine to have a copy! I left there with a very uneasy feeling. This is not my first house I ever built and I was never refused copies of anything from any other builder.

The reason for purchasing this home was because my 92 year old mother can no longer make stairs and this would have been ideal to get her in and out of the house. It also was a good time to downsize has I have far too much work in this home where I currently reside. My mother has since gone into Hospice care.

Sometime in December I placed a call to Maria Cerda expressing my desire to cancel the contract. It did not seem to be a problem when I expressed why I needed to cancel. I did not raise the issue of how things had gone down with respect to the revisions as it appeared we had a very cordial conversation with me explaining reasons why I needed to cancel. She said she would gladly sent me the docs to sign via email and I did so on or about December 28th 2016. I never heard a word back from her or any representative of Kendall Homes, nor did I receive any or all of my deposit. I made a few calls to Maria before I could reach her. We then had a conversation regarding my $3000. She told me she doubted I would get the $2000.00 back and I expressed to her the plans were improperly drawn, I did not receive a copy and therefore I received nothing for the $2000 and the entire amount should be refunded. To date, I have never received any correspondence from anyone from Kendall Homes to settle this matter.
