I went to Healey Brothers dealership on 09/2015 for a used car, told salesman i cant afford payments over $300.00 a month being a single parent of three boys I explained that i did not need a car i couldnt afford...I came with paystubs from both my jobs,W2's (the normal documents needed to purchase a car). Within mins he had me test drive a car under 10,000 promising me a cost no more then $300 a month with his lender. We signed a contract, I put $1200 down,I put insurance on it, he put plates and reg on it, handed me the keys and me and my son drove home with our new used car.
Almost 2 months later the salesman calls me and says hey i need you to come up with more income,the finacing fell through for the car. He already knew i had 2 jobs, i told him thats impossable for me to do. He then ask me to fax him some old child support payment documents and he could use that to increase my chances for financing. I knew right there I was being scammed, i told him absolutly not,I am not committing fraud because you couldnt do your job honestly. I got a free consult from a "lemon law" type of attorney. Things he told me to ask salesman 1) who did you originally get to approve my financing- then contact them to find it was ever even true- spoke with the guy who was "the lender" claimed he never agreed with car salesman. 2) Ask dealer for your down payment in the form of a cashiers check, because once you bring the car to them you are out both car and down payment- asked dealership to refund my downpayment in the form of a cashiers check, dealer said "i cannot refund your money,you have to return the car and we will have to figure out different finacing options. The lawyer told me 1 of 2 things will happen..1- they inhouse fund your loan 2) they take you to civil court.
Ok at that point i knew to put my monthley payments aside and when i reached the $1200 down payment amount i needed to go to a different dealership and return the car. 4 months go by and i head to a different dealer, well apparently Healey brothers was running my credit report for all 4 of those months and not only dropped my credit score, but restricted any credit reports being ran period! I was completly screwed. The following week a police officer showed up at my house and arrested me for unauthorized use of a car, spent the night in jail, never ever been in trouble with the law,never been arrested, not even a speeding ticket! I get out the next morning having to explain to my kids where i was, it was the hardest thing ive ever had to do. A few hours later a police officer from a different county knocks on my door to arrest me for stolen car off dealership property!! The DA took this case without even having evidance of these crimes being committed, when my court appointed crappy attorney spoke with the DA about the contract signed,keys given and spot delivery scam, she had no clue and requested an adjournment to speak with the owner of healey brothers. I was arrested again in the county that had charged me with unauthorized use, now for stolen car . Ive paid bail money, court fines and now my court appointed attorney wants me to take a plea from felony to a misderminor with more court fees over $700.00 on top of the $1300 ive already paid! I will not plead guilty to charges I didnt committ, im scared and no i dont have money for a good attorney to fight this. I cant help but not think justice serves only those who can afford it!
