I worked for Direct Marketing Specialists (DMS) which has a contract with Comcast selling Cable packages in SW FLA. Part of our independent contractor agreement was that they deducted 10% of each check up to $2,000 to cover any chargebacks I may incur after employment has stopped. There is a 150 day wait after employment for the chargeback period. Plus contract states "may take up to 3 weeks to process request". I put my request in on 3/17/17as my 150 days was up on 3/20/17. I received an email back the same day stating that I had 1 chargeback of $23.75 and my retainer owed to me was $1976.25. This is the 7th weak from my retainer return request. I have reoeatedly tried to contact DMS to find out what is going on and when I can expect the direct deposit only to be ignored and not responded to ever...ONCE!!! I also contacted Comcast Cable Corp in Philadelphia PA. to file a formal complaint. I can furnish plenty of proof that this money was taken from my checks , as well as many many emails to companies involved. I also have tried contacting the labor board and other agencies. Well I'd think Comcast should be able to help since they hold the contract for DMS and can get them to return what is rightfully mine. This blatant disregard constitutes fraud, theft by deception and breach of contract. This company lies and scams the public, the companies they do the work for n get paid by including Comcast/Xfinity, At&T and they don't catch it. MOST IMPORTANTLY, they steal from all their employees by not paying them their rightful commissions and not returning their security deposits which makes them illegally deducting money from employees paychecks. They also hold employees to the independent contractor agreement but not themselves. THEY ARE A COMPLETE FRAUD AND WILL STEAL YOUR MONEY!! The owner James Wildman is no where to be found or contacted and so called manger Ryan Siemens lies to be complicit in the fraud n theft. The payroll and So called HR departments won't even return any emails or phone calls which makes them also liable n complicit in the thefts.
DMS is absolutely a terrible company to work for or to be associated with. They sell cable door to door representing Comcast. DMS basically throws you out in the field to hawk products most people already have or can’t afford. Very unorganized company and managers who could care less about anything other then themselves. Beware of the wolves in sheep’s clothes!
