Explained my dilemma with Champion Mortgage and the sale of moms Mortgage from Wells Fargo after they sued for the second time. Basics Nationstar- Champion Foreclosure without proper notice to myself and my brother In MS

My brother and both on the mortgage Both should have received the statutory notice brother never received the notice even got notarized letter set to the church he never got the statutory notice from mortgage never got any notice for the hearing or selling house currently in court brother never got most recent court stating the lawyer will come to court because we filed all the lawsuit been 30 days and they never told him still

I the disabled one got 2 days before postdated a month the I did the same thing. They attempted Sell by auction nope SOLD they auctioned off and according to the basic NH foreclosure rules and Steven Bernstein JD you had many more. NOW COMES, the Defendants and respectfully moves this Honorable Court to set aside the foreclosure sale of January 23, 2020 on the grounds that no notice of sale was served or mailed to Defendants. The sale was a “chilled sale” in that it was advertised in the Union Leader a newspaper published in Manchester New Hampshire, Hillsborough County. The subject property 48 Pine Street, Swanzey, New Hampshire is in Cheshire County. In addition, the property did not sell for a normal price but was sold back to HUD for as an REO property for $45,000.

Sandra Loll died on July 27, 2015, and had taken out a reverse mortgage on the subject property on July 26, 2011.to Wells Fargo Bank, N.A. who later transferred servicing to Nationstar Mortgage, LLC D/B/A Champion Mortgage Company. The foreclosure sale is in direct violation of NH RSA 479:26 and contradicts the Affidavit of Theresa M Duggan, attorney for Marinosci Law Group, P.C. dated April 7, 2020, recorded in Cheshire County deed Book 3105, Page 895.

The Affidavit of Joseph Dolben, an authorized agent of Nationstar Mortgage D/B/A Champion Mortgage Company is flawed in that the Concord Banking a newspaper published in Concord New Hampshire, Hillsborough County and the notice sent on Dec. 4, 2019, has the wrong address of Mark Loll who lives in the subject property and Donald A. Kennedy, Esq., Guardian Ad Litem was not properly listed on the Affidavit of Joseph Dolben.

Defendants Mark and Jonathan Loll wish the foreclosure sale to be set aside as a “chilled sale” since they had no knowledge of the sale and wish the sale set aside and plaintiffs be required to auction the property again. Defendants contend had they known of the sale they would have bid $45,000 or more to keep the property which is valued

11. Ever since July 26, 2011, it has been alleged that Defendant’s Note and Deed were placed in a Federal National Mortgage Association (HUD) Trust and now the Trust has been transferred from Wells Fargo Bank, NA as servicer to Nationstar Mortgage LLC D/B/A Champion Mortgage Company.

12. After the death of Sandra Loll on July 27, 2015, there was a dispute over the taxes and insurance of $243 a month. Mark Loll, heir to the estate began living in the property at 48 Pine St., Swanzey, NH 03446 and began paying the $243 disputed amount. Suddenly, the Servicer refused to take payments causing a default. The defaulted amount was $10,000 or less however, the Servicer threatened to foreclose. Numerous phone calls and attempts to settle this matter fell upon deaf ears. .

• At least 25 days before the scheduled foreclosure sale, the lender must send you a notice of the scheduled foreclosure sale.

• At least 20 days before the scheduled foreclosure sale, the lender must publish a notice of the sale in a newspaper in circulation in your town or county. The notice must be published once a week for three weeks in a row.

• The lender must conduct a foreclosure sale at your home, or another location if specified in your mortgage. The lender cannot force you to leave your home on the day of the auction and you do not have to let anyone into your home.

• A third party, or the lender itself, may purchase your home at the foreclosure sale. Once a foreclosure deed is recorded by the new owner, you are no longer the owner of the property and should start considering other housing options.

My Dad was coerced into a Reverse Mortgage because of excessive medical bills. He was assurred that because he had a Truse leaving me the house and I was 62 that there would be "no problem changing the mortgage into my name" FRAUDULATED. When he passed away I was notified by them that I had 30 days from his death ( Jan 2 and this was the 29 of Jan) to PAY IN FULL the loan UNETHICAL and unrealistic. They began sending registered letters, sending people around to check out the house, and made intimating phone calls.

I finally had to sell the house after being threatened with foreclosure. In just barely 5 years over $130,000.00 strickly in interest. it is interest on interest on interest PREDITORY. Oh, and FYI there is only 1 Reverse mortgage company in the country...CHAMPION. The bank is in Dallas Texas and it NATIONSTAR/CHAMPION. Nationstar handles "loan modifications" and Champion handles "reverse mortgages" You have gotten your loan from B of A, Wells Fargo, Met Life, Citi...but the fact of the matter is that they are only "fronting" for Champion. Somewhere in the loan process your loan will be "sold" to Champion DECEPTIVE. If there is a class action law suit out there that I can get into please point me in that direction.

I am writing this report as I have been unjustly damaged by Champion Mortgage. First of all, I never signed a loan agreement with them, mas no money changed hands on either side. When I took my reverse mortgage loan out in February of 2010, I signed the loan papers with One ?Reverse Mortgage.

I have been workiung with a professonal who has been trhough foreclosure, and he told me that foreclosure is ukkegak ub tge furst okace, and second of all, I have asked them several times to provide me a copy of the note, and they have refused to do so. In my documents that I signed with One ?reverse Mortgage, it stated that Bank of America would be taking over, and I accepted that. I never received any letter or any kind of documentation that Champion Mortgage would be taking it over. Also, I found out that they are a debt collector and not a service provider.

I had sent them several letters stating that since they are only a debt collector, they can't foreclose, and come to find out, they aren't licensed here in Oregon to do anything, so everything they are trying to do, is illegal and smacks of fraud.

I had also sent them proof that fraud has been committed in the fact that they don't have any note, and none of the documents I have, there is only one signature and that is mine. I have done lots of research, and come to find out, when I signed with One Reverse Mortgage, I purchased the house outright with just my signature. I have asked Champion Mortgage to produce documents with their signature on them, and up to now, they have refused to do so

They are trying at this moment to sell my house from underneath me, as it has been listed on trulia.com, and I just found out the other day, after over 170 days, that it was there. I wal told by the professional that is working with me on this, that what they have done is totally illegal, and I can taje tgen ti coiurt abd sue them for three times the amount. If they don't leave me alone and drop this whole thing, that is exactly, what I might do, as that might be the only wa, that I can get through to them.

I want this company to stop with their unlawful business practices, and leave me alone, or I will do what I can to make sure that they are never able to do it to another person. I am 68 years old, and the man I am working with, told me, that my age alone, makes them so wrong, as he said that I have my age going for me. I do live alone, and I have nowhere to do, and they just don't seem to care, as all they want is their money they clai I owe, when they have no stake in my house in the first place.

I just hope that this company can be put out of business, so other unsuspecting peole, dom't have to go through what I have. I will do whatever I can to put them out of business if it comes to that.

A 76 year old woman took out a reverse mortgage in 2010. Dom champion mortgage. For over one year this company has claimed that she has not paid her property taxes or. Home owners insurance, despite forwarding several receipts/ accounting information hat proves her taxes and insurance are paid. This company has sent numerous threatening letters and several phone calls harassing this woman, despite the fact that her son is her power of attorney. Recently, she was informed that her home was foreclosed and sold at auction . This woman has dementia and the stress of this is causing her to become gravely ill. This is the reason that her son and power of attorney should have been contacted to be informed of he pending foreclosire. As she had submitted proof of payment several times, she was unaware of this issue and is now loosing her home. Chanpion has foreclosed this womans home due to a clerical error, -and will not even speak with her power of attorney when we call for assistance. Addotionally, champion mortgage has had a contractor call every one of this woman's family members to receive the check for the sale of the home.

My mom got a reverse mortage on her home to help in case she needed extra funds for her medical condition. Up to October 2015, no issues. Then she got quite sick and has been hospitized and in rehab since July 2015. She needed to borrow $8000 to pay for some repairs on her home as per her dr she is not able to come home until the repairs are made (due to mold). I have been helping mom with bills and such during this period and currently as she is nt quite up to dealing with all this while rehabing after her second surgery. She requested the money the beginning of October via mail- like she has done before. As of today, 12-1-15, we have not recieved the funds. They claim they mailed out 2 checks- neither was recieved. She has placed calls to them as well as myself. They say wait, its coming. I asked if they can send out a check registered mail with tracking. They said they don't do that. I faxed in a canceled check today with a note- per the person I spoke with. Supposedly the money will be deposited in my mothers account in 48 hours- one day for processing and the next deposited. Lets just say, I'm not holding my breath. I hired a contractor to remove all the damage but now we are stuck as we need to start putting things back together. I rented her an apartment during this time so she has a place to call home until we get her "real" home finished. No ability to review imformation via an online portal, like most places, lack of caring as far as customer service and sketchy business practices. Not a place I would do business with. It has also soured my view of Key Bank as they were the oes who hooked her up with this place. Doesn't seem like something Key should be doing.
