Elizabeth Rodriguez a.k.a. Elizabeth Ramirez a.k.a. Elizabeth powers. Sergio Rodriguez a.k.a Sergio Ramirez a.k.a. Sergio Lawrence This company alleged that they prepare loan modification packages for homeowners behind on there mortgage and facing foreclosure. 23 August My first conversation was with Perla Riestra. I spoke with this individual and explained upfront that my income was limited The pitch was very inviting. She had me believing that this alleged company had my best interest at heart. On that day I submitted documents to via fax as Perla stated that Sergio would review in effort to see if I qualified for a home loan modification. Sergio: That same day I received an email from Sergio With the words "congratulations" typed at the top of the email saying that I qualified. I found Sergio upon receiving the email to obtain clarification. He informed me that they would begin preparing a package to submit to my mortgage company once they received payment and a signed contract. Perla: this employee informed me that the cost to prepare a mortgage modification package to submit to my mortgage company was3750.00 in the form of a wire transfer only. . this was expressed and was very important to them...that payment or confirmation of payment in the form of a wire transfer (receipt) was received before they would begin any work.

I explained that I did not have that type of money and that I had merrily half of that available which was my disability income. She said that they would take that and except two separate payments but before they could begin work, they had to receive immediately 1625.00. I was advised that upon receipt of this money work would begin immediately and, within 24 hours my package would be submit it to my mortgage company. This was 23 August 24 hours had not yet passed, funds were removed from my account in the amount of 1625.00 try noticed when I checked my account. I immediately called the bank and informed them that I transaction took place that should not have taken place. I was told that because the transaction was submitted as an ACH it would be returned by Bank of America as the routing number was a wire routing number not an ACH routing number . At that time I was very thankful and thought that my money would be returned. 24 August 2017 and mediately following a discussion with a person that works to assist veterans, I quickly phoned this alleged business.

Sergio: When I spoke with this person I asked if he could explain briefly the status of my package. He stated that it had not yet been worked on and this was after 12:00 . I mentioned briefly that I was given information indicating that the business that had a questionable reputation and that I would feel more comfortable if he could provide a better answer to my initial question . He became very angry and belligerent. In fact, he stated to me "you seem to have a problem with trust" It was at that moment that I realized that I had made a huge mistake. He continued to speak raising his voice as I attempted to ask questions. When I advised that it was then my right to ask questions particularly when I had a legitimate concern as at that time they had my money and there was no guarantee that it would be returned. It was at that point that he said we do not want your money in fact "KEEP YOUR MONEY! WE DONT WANT IT !IM DECLINING YOUR CASE!" Elizabeth: This person spoke with me and on a recorded line admitted that her counterpart Sergio stated clearly that my case was declined and that they did not want my money at which time the only conversation that should've occurred between me and Elizabeth was the date that my money would be returned. That same day I posted a review of this alleged business at the Better Business Bureau website.

And I waited a few days as my bank advised on my funds to be returned which never happened and I begin sending emails to Elizabeth Sergio and Perla. I also found several times no answer at all until 30 August. Perla and Elizabeth: 30 August, I received a phone call from Perla stating that she had Elizabeth on the phone and she would transfer me to her. During that conversation I tried my best to maintain a level head. She stated that a check was mailed the day before 29Aug2017 I actually believed her. I received an email from her and I found it odd that at the end of the email she stated that I should be patient because they cannot rely on the Postal Service. The next day 31August2017 I sent an email requesting confirmation of the amount of money and the day that it was sent. I received no response I tried to call I was sent to voicemail, left multiple messages and no one phoned me back. I received error messages from the emails sent from my primary account. I Sent an email from a secondary account and the message went through. Later that I received a belligerent email stating that the check was mailed (Yesterday) (30August)! This meant that they did not mail the check on 29 August they allegedly now mailed the check on (30th of August). Same day August 31: On this same day 31 August which was yesterday as today is I received a horrible email stating that the check had been mailed however do not cash it because a stop payment was placed on it because I filed a Complaint against their company when in all actuality it was a review at the time that I filed it it was my understanding the funds will be returned because of a technical error.

List to say this outcome is not what I anticipated and justifiably I have every reason to file a complaint now at the Better Business Bureau and to leave this post as no one has the right to play with the lives of people out of greed and selfishness. Do not call this company do not listen to their words as they will downplay anything stated against them. The last conversation I had was on today one September 2017 with Elizabeth where she yelled at me and I'm so thankful that I recorded the conversation this time and I informed her while she was yelling as she did not give me time to speak. She stated very clearly on the recording that she did not care if I was a disabled veteran she had no sympathy for someone that would try to hurt her company( she was making reference to my review at the Better Business Bureau website ) The conversation did not go well and she hung up on me as I was speaking.

I do have a legal leg to stand on here which she blatantly stated I do not. I copied what I could from the email sent to me following their discovery of my review on the Better Business Bureau review section. Ms. ****** I just sent you an email letting you know we had already sent you a check as refund, however I was not yet aware of the complaint you placed on the BBB against Capital Home. We had and have every right not to refund however as I told you we are not in the business of keeping monies not earned even though you signed our contract. We try to be fair, and even if we started our process we were willing to refund you. However, that has changed. You will receive the check in the mail , do not try to cash as I have placed a STOP payment. This is what you unfounded complaint you placed against us resulted in. I worked for this company for approximately 2 months and I myself was ripped off. I thought they were legitimate, but as time went on, they were hiding a number of things from their employees. I should have known something was wrong from day one, but I continued to give them a chance, but as time went on, I became more suspicious of their practices.

I was eventually terminated for asking too many questions as to why clients kept calling in and complainig about them not doing or providing the service they promised. They are pushing themselves as a Document Preparation company instead of what they are, a Loan Modification company.

They do this to get pass the law, so they can charge consumers upfront for loan modificatons, which is against the law. I personally am not a lawyer, but their obviously is something wrong, because all their processors quit on them, and they failed to tell us for more than a week when we as employees noticed they were no longer there.

They hire people to come in and get deals in, and once the employee starts to realize something is wrong, they fire them or when the employee builds up enough clients, before they can get there commissions, they fire them so they can get all the money.

On top of this, they are telling people they don't charge for a Chap 13 bankruptcy, but are by increasing the fee. They are also, waiting approximately 30 days or more before contacting lenders to do the modification in a lot of cases so that the cleint pays the complete fee, before moving forward with the process. Then if the client fells to pay, they use the contract as a tool to keep the funds indicating the cleint failed to adhere to the contract.

STAY AWAY FROM THEM, and find a company that will not rip you off.

I got a mail piece and it said if I needed mortgage relief call the number, I did because I had a sale date on my house coming up in 7 days. Long story short after 2 days of turning In Documents and signing contracts, paying almost $5,500 deposited to their BofA account, running frantic and then believing that Liz had talked to the bank, she said she did and sale date on my home was stopped because the modification has been approved and bank just needed taxes & w2s bank statements and a whole bunch more to submit cause the bank is waiting for the documents.

I believed her and we lost our home three weeks later as the bank came while we were getting food and changed the locks on every door because the house was already auctioned when she told me she got an approval. I had a stroke and heart attack at the same time. Next day, I called for a refund, which she told me I would get if they were at fault, which they admitted, then nobody will call me back. All I can reach are case managers who don't know my case, and nobody will due anything. Predators, scam artists, liars, and theives. Don't trust them, just run as far away as you can. They will tell you anything to steal your money. Run!!!!
