I got a phone call from Beth Winstead shortly after she found my brother’s (Andrew Carey) obituary where we discuss his hoard in her storage unit. He passed away on 6/6/2020. At the time I didn’t know that a storage unit contract even existed let alone a key. I also didn’t know that this storage unit existed until I got the phone call. So I had no choice but to pay these 2 months of storage under false pretense and she never mentioned the contract in the phone conversation. She also told me that my brother had drawer after drawer full of tools and several motors on lifts, which I told her she could have the stuff after she asked me what she should do with it. My brother was a mechanic with a hoarding disorder. I didn’t have room for it and I just got excuses from the other heir who I don’t claim as a brother.

I don’t know why Beth Winstead was putting on the dumb act when she asked what she should do with it (my brother’s stuff) when she knew exactly what her contract said if the tenant doesn’t pay the rent or at least she should have known. **See part of contract at bottom of page. If I had this contract at the time Beth Winstead called I sure would have done things different like she sell his stuff to cover her losses on her storage fees and what is left of the fees will then be paid out of my brother’s estate or pay if she made more than the 2 months of storage fees. So she broke her Contract also.

I did finally find the contract on the same day (Jan 4, 2021) I sent Winstead a facebook message after taking a picture the same day (image 1&4). Beth Winstead refused to make things right with me because if she was honest she would have sold my brother’s hoard to pay for any fees out of the sale instead of conning it out of me and if there was anything left over than the unpaid portion would have been paid out of my brother’s estate or her pay me if the sale got more than the 2 storage feed. I still had to deal with several bins and boxes full of papers, magazines and other stuff even into 2021, where I had to go through them after the hoard (see image 2) was cleaned out of my own rental property which took me a while where I found a small leather checkbook that had a small folded up paper that turned out to be the contract.

I tried contacting Beth Winstead through snail mail, email on one of her websites which has since been taken down and on facebook (image 5) where she not only ignored me but blocked me on facebook when all I wanted was an accounting of my brother’s stuff in her storage unit and I wasn’t even asking for money after the other heir threaten to take me to court if I didn’t pay $3000 that he absolutely had no proof of cost of his stuff. And that is all I was wanting was proof regardless of what she did with it.

Sgt Brian Brown of the Lafayette Police Department in Indiana just believed everything this Beth Winstead said and nothing what I said and he didn’t even investigate this. I got tired of going around and around with this cop. This cop would not accept any images that I sent him either.

This is the lame excuse that this cop gave me when he couldn’t come up with anything else since Beth Winstead and I talked about the drawers and drawers of tools and several motors on lifts on the phone and asking me what to do with the stuff. And now she is blaming the missing stuff on someone else having a key which don’t even make any sense. She had the keys and she didn’t see to it that the stuff was safe until she either gave it away or sold it and came up with this excuse to not have to make it right with me. She sure conveniently forgot about the tools and the motors because it was never mentioned by either Winstead or the cop in the emails.

So why didn’t Winstead tell me this when I tried to get an accounting of my brother’s stuff where the requests started shortly after the phone call and ended on Jan 4, 2021 (image 5)? It was the cop who relayed the message to me toward the end of our email conversation which lasted from February 26, 2021 to March 11, 2021, if this was really the case. This message was sent on March 10, 2021. Just find it unbelievable since it was now mentioned.

So I want her to be honest and now give me a refund of $540 for the 2 months I paid or estimate the worth of all of the tools, motors on lifts so that amount can cover the storage fees and my brother’s estate will pay the rest which is how it should have been on the phone after my brother passed away, if she told me about what the contract said.

** Here is the part of the contract that speaks of the fee and the contents inside

“Tenant hereby grants Landlord a lien on all property stored in the unit to secure the payment and performance of all obligations of Tenant under this agreement. Failure of Tenant to pay rent when due, or any other breach of any condition of this agreement, shall be deemed a default by Tenant. In the event of a default by Tenant and immediately upon notice to Tenant, Landlord may enforce its lien by: (1) Overlocking the Unit preventing entry into Unit by Tenant: (2) Entering Unit and taking possession of and removing the contents: and /or (3) Selling the contents of the Unit not earlier than sixty (60) days thereafter. The proceeds of such sale shall be applied firt to the expenses and the sale, including legal fees, publication costs, and all expenses and costs relating to taking moving and storing and preparing the property for sale, and second, to the satisfaction of all unpaid rent and other sums due under this agreement. The remaining proceeds if any, may be claimed by Tenant from Landlord within on (1) year of the date of sale. Tenant shall pay a fee of ($45.00) to Landlord for any overlock of Unit and ($10.00) for any written notices of default to Tenant pursuant to the agreement.” (see image 4)

All of this could have been avoided if she worked with me instead of ignoring me under the circumstances. The fact that this about, “only a few things in storage unit” were suddenly brought up because she and the cop wasn’t getting anywhere with me. I feel like she gave the stuff away rather than abiding by the contract between my brother and her where the stuff should have been sold to cover at least part of her storage fee.
