In January 2017 I made a deal with Colby to buy my mother's lease tank from him. He gave me a receipt as I paid him $100.00 cash. Then in March 2017 I mailed him a money order for the last payment of $100.00 dollars.
Here is the story:
Colby would hold my mother's checks fro up to 3 months. This would confuse her and make her really upset. This has been going on for the last 6 years. He was also very hard to get on the phone as he would wait until after 9pm to call my mom back. This was my mother's business so I did not get involved.
I started trying to take care of her because she was not doing well. The Feb 2017 and March 2017 check's that my mother wrote him did not try to clear her bank until April 22, 2017. Here is the said part. My mother died March 9th, 2017. She wrote Colby the checks before her death. The bank closed her account and I did not have access to the account as I was not her account.
Colby called my son to get money from him. He also called me to get money. I told him that I was not responsible for mom's bills as she had died. He could come take the propane out of my tank that I bought and have the receipts for. Well I came home from work on a Thursday and I found out that my tank was gone. I reported this to the Police.
Colby told them I could sign an new lease and pay him 92.50 for the hot check. Colby sent me several text messages and made several phone calls. He was so rude that I called my cell company and had his numbers blocked.
In the mean time I have talked with several propane dealers in my area and people that have stated they will never use Action Propane Colby again because he will hold your checks for several months and he will cheat people.
I am not sure if this will help anyone but here in Ponca City, OK I have been without propane since April. The weather has been as cold as 32 degrees. I have been using the elect heaters. I cannot cook or heat my home as I don't have propane and the weather has been to bad for a new dealer to get into my yard.
