I was hired two months ago at a company called accident care specialists as a licensed massage therapist. In the beginning I got along with everybody in the clinic, most of which were of the Vietnamese community while all of the massage therapists were typically white American women. there was one employee in particular named Minh, and she always had an attitude towards me during every single transaction. She was the receptionist there. I asked around to some of the massage therapists I worked with if perhaps I had done something to offend her culturally or otherwise and every single person I asked told me no, that's just her personality she acts like that with everybody. I have a disability called polycystic ovarian disease which causes my hormone levels to go haywire and leads to side effects such as extreme nausea and vomiting as well as severe sweating dizziness and general fatigue.

When I was first hired I informed my supervisor of this and that I would need a cooler climate for the room that I would be working in. Instead I got put in the hottest room in the building which also had a thermostat built-in. I thought the thermostat only control that room so I turn the thermostat down to a temperature that was comfortable for me to be able to work without being sick. Pretty soon some of the other staff were complaining about how cold it was and I apologized, not realizing that the thermostat affected the entire building because I was told that it only affected my room and one other room in the back. So the supervisor allowed me to work in a cooler room and everything seemed fine. One of the policies for the massage therapists working there, is that we go up to the front to see if our patient has arrived when they are due, and if they are not there we are supposed to go back to our rooms in the back as to not linger around the front desk.

The receptionist is supposed to come get us when the patient arrives. Minh always gave me an attitude no matter if I came upfront or if I waited in my room. A couple nights ago after having checked to see if my patient was there, I went back to my room to wait for their arrival. Minh came back to my room and started yelling at me and berating me about how I need to get up to the front. I told her that I did go up to the front to check to see if my patient had arrived and they had not. She then proceeded to argue with me and was very verbally abusive and extremely inappropriate. That night I called the supervisor to let him know of my complaint and that I wanted to file something formally and that I had expected an apology for being treated disrespectfully and he said he would look into it.

The next morning he called me and told me he had looked into it and that the entire staff said that they felt uncomfortable around me and that I gave been attitude and was always a negative vibe in their clinic. He also told me that he had called several of my patients and they told him the same thing which is absolutely untrue. I told him I wanted the opportunity to have a meeting with everyone who seem to have these feelings towards me and he agreed, however when I arrive it was only him and Minh. They both proceeded to berate me and tell me that I haven't been doing my job and that I've been bringing a negative attitude to the workplace and that I was fired. The next day I asked for a copy of my personnel file as well as demanded my final paycheck as it is the legal right when one is fired, and the manager agreed.

When I arrived to pick up my paperwork I noticed that in my personnel file there was an incident report that was filed by Minh yet in the place where is designated for the employee signature there was no signature there because I had not been shown the incident report because it had just been made on the spot, and they typed it up the way I had expressed the incident from my perspective only they put it in the opposite perspective to make me look like the one who was inappropriate. The supervisor also told me that one of the reasons everyone felt so hostile and vindictive toward me was due to my disability and that they didn't feel that my personal problems should affect them. I informed him that that is discrimination and I am protected under the Americans with disabilities act. He said he did not care and that there was nothing I could do about it.
