I am writing in regard to $792 that was taken from my bank account by Tapout Fitness, Dallas Georgia Location. I never authorized any monthly monies to be taken from my account.
Dec 6, 2017 My husband, myself and my 2 sons went to the Dallas Georgia Location to find out more about your kids martial arts program. We met with Sam Dunlap, and Sam Dunlap told me he was the owner. After a 30 min free lesson with Sam, I discussed with him our desire to sign up my youngest son for some classes. At this time, our son was on break from his travel baseball team.
Sam told me that the program was $99 a month and was a minimum of 6 months. I explained to him that starting in March, our son would be heavily involved with his Travel baseball, and we could not come to class. We discussed the fact that Sam was trying to get young students enrolled, and that he would love to have our son try out the classes. So Sam told me, that he would let us do a Three (3) Month Trial Membership if we agreed to pay UP FRONT for the 3 months. He also cut the enrollment fee from $99.99 down to $19.99.
Sam told me that he WOULD NOT enter my credit card information into the system, so we would not be billed. We agreed that after the 3 months, should our son want to continue with classes, we would THEN HAVE TO sign up for the $99 per month program. Which I agreed I would do.
So that day, I gave Sam our information and I wrote on the 1st page of the info form, that I was agreeing to pay $316.99 THAT DAY for a one time 3 month membership. And that was for 3 months at $99 plus the $19.99 enrollment fee. Dec, Jan, Feb.
Our son had a Friend, come to the gym and sign up. I was told by Sam when we signed up for our 3 month membership, that we would get a FREE month if we brought someone in who signed up.
The day the friend signed up, I talked w/ Coach Alyssa (spelling could be wrong) about being able to add an additional month on our sons account which would then bring us up through March. Coach Alyssa said I had to talk with William Carpenter. When I talked w/ William Carpenter about adding the month on to the end of our 3 month trial, he said that that option is no longer available. So I had discussed our 3 month agreement with both Coach Alyssa and William Carpenter (the other owner).
When our son was there the last time, and the end of February, my husband told William Carpenter that we would not be back. We were done and baseball was starting up. In our minds, we paid for 3 months and our son took classes for 3 months. Done.
Well I used an account for the one time payment of $316.99 that we do NOT use often and literally last week, October 11th, 2018 I looked at my account and there was a charge from TAPOUT FITNESS for $99 the day before. I just about flipped!!!!!! I then looked back over the months and there were charges for $99 each month since February.
Tapout Fitness, owes me $792.00. I am not disputing the $316.99 I agreed to pay, but I never authorized a monthly membership fee. And I have proof. So i have paid Tapout Fitness over $1100 for a 3 month one time trial membership
IF I were signing up for a Month to Month $99 membership, why on earth would I pay $316.99. That does not even make sense? I would have paid for the 1st month and then the Enrollment Fee of $99 for a total of $198.
Why would Sam take my payment of $316.99 if it was NOT an agreement we had made that day?????? $316.99 was not a combination of any of the fees noted on the documention of membership options. So this is PROOF of what I have been saying.
This was a ONE TIME – 3 MONTH Membership.
So Tapout Fitness in my opinion, charged me fraudulently each month. Had in my mind knew I was signing up for a month to month program, I would have followed up with my bank and Tapout and cancelled the monthly draw when we were finished. That is what I have done with other month to month programs.
But THIS TIME it was a One Time – 3 Month Membership. Why would I have to cancel something I NEVER agreed to! !!!!!
