On 6-24-2016, I purchased an auto for $10,500 from S.W. Auto. This is the 5th car that I have purchased from S.W. Auto. My salesman was Joe Chan. I always ask Joe if the car is in good condition. His answer was yes. Therefore, I had no problem signing an "as is" contract.

The next morning I had to run an errand and when I tried to leave the car would not start. The battery was down, so I thought I had left the lights on. I had the battery checked and found it was the original equipment, 8 years old, and needed to be replaced. I replaced the battery, the automobile still would not start. I called S.W. Auto 3 times and Joe refused to take my call or return my call. I hired a wrecker and hauled it to the dealership.

The dealership replaced the starter and the door jam striker plate. I then sent the car to an independent auto repair shop because I thought I saw an oil leak. They replaced the gravel shield and repaired the rear seat upholstery that was damaged. I wrote a registered letter to Joe's registered agent for S.W. Auto asking them to reimburse me for $1,575.43 or I would file suit. I did file suit and I lost that case be cause of the "as is" contract.

I would not purchase an auto from S.W. I have known Joe Chan for 10 years. I just have not met this Joe Chan before.

My expenditures for repairs on this auto have exceeded $5,000.

Our son Kenny recently received a medical discharge from the AirForce. He served his country with honor for 10 years.

His transition into civilian life has been difficult. He moved from Alabama to our home in The Woodlands, Texas. Enrolled in school and found a part time job.

The rain storms here have been record breaking. On his way home from school he got caught in flood waters. The insurance company totaled his truck. The money he received from insurance didn't even pay off the vehicle, leaving him with no truck but still making payments.

His 83yr. old grandfather wanted to help Kenny out and gave him 10,000.00 to buy a vehicle that he wouldn't have to make payments on.

Kenny found a mini-Cooper at SW Auto of Houston LLC. The car was perfect for him, especially since it got such great gas mileage. That would help him to travel back to Alabama to see his 17 month old daughter. Kenny asked if they gave Veterans discounts. No, SW answered.

The price was a little over the $10,000.00 his Pop sent him, so we chipped in. On his way home with the car, Kenny noticed the car wasn't running right. His friend works at Mini-Cooper in The Woodlands and told him to bring it in for a check. Diagnostic testing was done with a full written report. The car was determined to be unsafe. Cost of repairs would exceed the price of the car by $15,000.00 dollars.

Kenny immediately contacted SW Auto and reported what the dealership found. He also faxed a copy of the report to them. A man named Joe said he would inform the owner and get back to Kenny. Nobody would return his call. This went on for a week.

Finally he did get through and told them he either wanted his money back, or another vehicle of similar price. The call was on speaker phone at SW Auto. A woman in the background stated she was the owner and that the car was sold AS IS, and if he had any more issues to call their attorney. No exchange, no money back and no running car.

I can't tell my Dad what happened for fear of him getting really upset. Kenny gets a ride to & from school, but lost his job due to no vehicle.

This just isn't right and someone needs to make it right. I'm at my witty end. Can anybody please help us?
