They were supposed to send my portfolio to potential people who might be in the market to buy or make my sheet for distribution. The only thing they sent me each month was a list of companies and their addresses to see if they might be interested. The only answers that I saw was they were either out of the office, on the phone or would return their phone call. Never did I see that they actually talked to the individual that was supposedly to have received the portfollio. There was supposed to be follow ups but never did i see where there were any. I had supplied them with a finished product of my portfolio as to how the sheet operated so all they had to do was copy that. There was never any schematics for them to draw up. It was already dne. I never saw so many people that were either not at their desk or werre gone for the day and never returned phone calls. I paid a total of ten thousand dollars for what they were supposed to do. I would like to collect all that I paid to them. I feel they did not do their best to sell/manufactur the Bifurcated Sheet that I invented.

possible licensing agreement

Thanks for the insight, I received a business card from PWM, asking if i would be interested in a licencing agreement. after the google search it was just as i thought another scam, trying to bilk me out of more money with the promise of success. its so hard and expensive to get a product prtotyped and sold. i was hopeful that i could do it but alas this is not the one. thanks mike l

Pacific World Marketing LLC has been a God send for me. For more than six years it has been promoting my patent to relevant companies. I had employed several other marketing companies, as well, at the beginning. They made a one-time, perfunctory attempt at promotion and refused to try again even at my behest. Pacific World Marketing did not negotiate a license agreement for me.

PWM was not included in the negotiations because Ken did not know enough about the product or the business.

The manufacturer contacted me because of PWM's misrepresentations and being professionally inadequate.

Unfortunately PWM is the greedy one, they got the money and didn't do a darn thing for it!

If PWM had anything coming they would have come after it!

Pacific World Marketing LLC had a License Agreement for you in 6 months

Your original complaint was in 2007. 9 year later.

There are a few pieces of the puzzle here that Anita must have forgotten.

Anita's original complaint was for non-performance and misrepresentation.

Every inventor understand how difficult it is to get there product to the market. Many inventors dream of having his or her product licensed.

The main purpose is to set the record straight about Pacific World Marketing and make sure everyone has a complete picture.

Anita was granted the patent in 2003 and all of her efforts to market her own product could not produce success. She tried marketing the product for many years before contacting Pacific World Marketing to help market the product.

When Pacific World Marketing was hired to perform the marketing services of this product our #1 goal was to secure a license agreement. I am pleased to announce we obtained our goal! In only six (6) months of marketing the product we received a license agreement for her product.

If Pacific World Marketing did not perform and/or misrepresented the product in an unprofessional way how would it be possible to receive a license agreement? Pacific World Marketing marketed the product for only six (6) months and had a license agreement in place!

Prior to Pacific World Marketing sending her the licensed agreement we received an email stating I am very pleased with how everything is going

Once Anita realized she had a license agreement in place, thanks to Pacific World Marketing she decided to contact the manufacturer directly.

She had no contact with the manufacturer throughout any of the negotiations. The only reason she would contact the manufacturer directly was to cut Pacific World Marketing out of the shared royalties.

Upon receiving the license agreement Anita decided she did not want to pay Pacific World Marketing for all of the time and efforts exhausted in marketing and licensing her product. She contacted the manufacturer directly and cut Pacific World Marketing out of any royalties. Was she was feeling a little greedy or was she thinking let's hire a professional marketing firm and once they land a license agreement we can cancel the agreement. Unfortunately it does not work like that!

Since Anita was unsuccessful in launching her own product for many years, it is safe to say the marketing campaign, marketing strategy, negotiations and hard work from Pacific World Marketing resulted in a successful license agreement. We reached the goal set forth in six months.

Without the efforts of Pacific World Marketing this product would never have had the opportunity of a licensed agreement.

In the end and again Thank You to Pacific World Marketing Anita received a license agreement for the product. We are entitle a percentage of the royalties but have decided not pursue any royalties. The thoughts from the team at Pacific World Marketing we did our job and what goes around comes around

Information About Pacific World Marketing For Future And Current Clients

I was a client of Pacific World Marketing (PWM) out of Brentwood, California for a little less than 5 years. Approximately 10 months into my 2-year contract, I refused to pay the remaining 22% owed on my contract due to concerns about how and when my product was being worked on. Ken Maghuyop, CEO of PWM, agreed to consider my contract ‘Paid in Full’ and was willing to continue to represent my product for the life of the patent. Unfortunately, I continued to have many of the same concerns and would often express them to PWM. Licensing agents did attempt to contact company decision makers by phone but, more often than not, these decision makers were not available for a variety of reasons. Approximately 300 emails were sent out to companies but roughly 80% of those were follow-up emails and only 20% were sent to ‘new’ companies. A more telling statistic is that in my time with PWM, approximately 58 companies were contacted. That averages out to be only 1 new company per month. After 4 years and 10 months into my relationship with PWM, when I had heard NOTHING from my licensing agent in almost 19 weeks, I requested a partial refund on the basis of false and/or misleading advertising. I felt what the PWM current and/or previous website promoted in terms of benefits and the implied potential for client success was definitely not consistent with what they actually provided or happened. Ironically, less than four weeks after my request, the PWM website was changed. Many of the items I referred to no longer appeared. There was only one other time during my involvement with PWM when there was a major appearance and content change to their website. According to Mr. Maghuyop, PWM had done nothing wrong. That was in response to my claim that my product was an extremely low priority for PWM since it was being worked on inconsistently and, in my opinion, often only minimal time had been spent on it when it was worked on. My product was supposed to be worked on every 2 – 4 weeks. Therefore I found it strange Mr. Maghuyop had no explanation for the almost 19 week time lapse. The longest time lapse was 21 weeks. However, time lapses of 10 weeks or longer were also common. Mr. Maghuyop denied my request for a refund but was still willing to represent my product and get off to a new start. I briefly considered staying on with PWM since the only way it re-pays any contract money is if a product is licensed or the rights to a patent are bought outright. Within a week Mr. Maghuyop even came up with a list of 18 new companies that could be contacted. That was interesting because it took licensing agents anywhere from 1 -2 years to come up with and contact that same number of new companies even though 19 of the 58 companies were at my suggestion. Unfortunately I felt there was no guarantee the same issues of minimal and/or non-quality time being spent on my product wouldn’t happen again since that had been the pattern in the past. Unable to get passed the frustration and bad feelings I had about PWM, I did terminate my almost 5 year relationship with the company. I believe actions speak louder than words. I got tired of being told things that either didn’t happen, were misleading or weren’t true. Over time my trust in PWM became non-existent. Appearing now on the PWM website in bold lettering is, “We didn’t invent marketing, We PERFECTED it.” For my product that was definitely not the case.

Future and current PWM clients may find the following recommendations helpful. (1) Your contract amount could be determined by the royalty percentage you would receive if your product is licensed. Since the odds are against your product being licensed, pay the lowest amount possible. (2) If there are payment options for your contract, pay your contract amount over the longest period of time possible. (3) Your contract should not include anything like the following: “In the event Client has not received such a report (which failure shall not be deemed a material breach hereunder) client may contact PWM to request a copy.” A client should never have to request reports that PWM has a contractual obligation to provide. (4) Maintain a record of all communication and correspondence. Also tape all phone conversations but be sure to get permission from PWM first. (5) Know how often your product will be worked on, the minimum number of companies to be contacted and the breakdown of companies being re-contacted compared to new or never before contacted companies. Be sure to get that information included in your contract. (6) If you have concerns, address them with PWM. Be aware that Mr. Maghuyop is a very skilled and persuasive communicator. Therefore be sure your concerns are fully addressed. (7) It is important that PWM represent your product for the life of the patent, at no additional cost, since it is likely your product would not be licensed within the 2-year contract period. Be sure to get detailed post-contract commitments in writing since those commitments (in my opinion) are also part of your contract and what you are paying for. Following these suggestions could improve your chances of becoming a happy client of PWM. I assume PWM does have many happy clients. I was not one of them. PWM could be successful in getting your product licensed. From information I have gotten from Mr. Maghuyop, I have concluded that approximately 1% or less of the PWM products do become licensed. The other 99% of their clients are out the entire contract amount if their products are never licensed or bought out while under contract with PWM. Clients are never guaranteed a licensing agreement will result. However, what clients should expect is honesty and the sincere effort that could result in a licensing agreement.

First and foremost we are very sorry your product was not picked up for Licensing!

We were surprised to hear after 5 years of working on your product you wanted to give up on our marketing efforts.

We worked on your product from 2014 to 2019. Having marketed the product for 5 years we never gave up on your product and would not have given up! We will never give up! Another client we work with took over 5 years to secure a License Agreement. Last year we signed a 17 year License Agreement which took Pacific World Marketing 3 years. We marketed the product for 3 years before securing the License Agreement.

On April 25th, 2019 we secured a License Agreement for a client we have been working with since September 13, 2011. 8 years later we secured an agreement!

Do we want to work on a product for 8 years before securing a License Agreement? NO, but we will if that is what it takes.

Can we at Pacific World Marketing honestly say in 5 years we gave it all we had, YES. Can we honestly say we could have done better, we can always do better and our job is not complete until we find a home for your product. Our number one goal is to License the product. Having working on the product for 5 years we still believe in your idea and still believe you have a good product.

We originally reviewed your patent in 2014, if my team felt the patent was not marketable or we had zero chance of securing a License Agreement we would not have not elected to represent the patent.

We make no misleading information that we can work with anyone who is granted a patent or that they will have financial freedom. We do inform every one of the odds of securing a License agreement and also explain that it is a long road and a long haul ahead. We do not sugar coat anything with anyone.

What we can promise is if you are a client or future client, we will give you everything we have and will not give up!

With respect to your concerns with changes to our website, we have had 2 major changes to our website in 13 years. Most companies are constantly updating their website with new information and better user interface. From time to time they have a full remake with a new and more updated design. They also add new features and make the website more user friendly. As for changing content a company like Walmart or Nike changes there content all the time. Again we have only updated our website twice.

Nothing would have made us more excited and happy to inform you that we have a company interested in licensing your patent. That is what we sign up for!

When we entered into an agreement together on February 22, 2006, it was agreed that we would market the product to companies to license the patent, not to manufacture any units ourselves. This is why you have not received 1 manufactured product.

We stopped marketing the product after leaving you numerous messages, and not receiving a response since 2010. If this were not the case, we would still be marketing your product. We even continued to work on it after you contacted us October 9, 2007 stating you had not forgotten about your payments, and had a little storm in your life causing you to be behind on them. Our reply to that was to not worry, and that we would continue to market your product even though you were behind on payments, and we did exactly that.

We marketed the product for over 4 years, and since marketing the product in 2006, we have sent well over 250 emails, and shipped many product portfolios to manufacturers for the possibility of licensing the product. As promised, we would market the product for as long as it took to find a company to secure an agreement.

Again, at Pacific World Marketing, we do not give up. We would be more than happy to continue marketing the product for Licensing. As indicated in our marketing agreement, we do not charge for any extensions to the agreement.

This month, we secured two (2) Licenses Agreement for our clients. One of the License Agreements was secured for Stacy S., and took over three (3) years to secure. The other License Agreement was for Bryan B., and took over five (5) years to obtain; but now they both have a secure License Agreements. We worked on Bryan's product for over five years before obtaining an agreement for him.

We never received a concern or complaint from you in all the years we worked together, and again, we are sorry to hear that after 9 years, you are not happy. Back in 2006 Pacific world marketing Contacted me Regarding A patent I have legal rights in Regards to marketing The products for profit. The deal I made with them was they get 35% I get the 65 percent my cost of investment Was 11,175.oo dollars Paid in full. Until this day I have not received 1 manufactored product from this company.

You are not alone

PWM does not manufacture anything. But I have my story with them and I do mean them; a husband and wife team that solicited their company as having a full marketing staff but the staff is them but you never know that Michelle Waufle is his wife and only staff.

To set the record straight PWM called me soliciting his marketing services too. I will never forget what he said when he called, Anita, you have to trust someone. I felt like so many patent holders do, internet selling is doable but manage nation wide distribution or more, that is too much for us operating alone. Back in 2007, I paid PWM up front and never got anything back. They got $14,250 from me for marketing and I got one page posted on their web-site that didn't do anything. PWM was suppose to have two professional packages done in 60 days, one for the web and the other for potentially interested companies for licensing and this came with his 99% guarantee of a license agreement in 90 days and world wide distribution for my product. Six months into this arrangement a distributor called me and was interested in distribution, I gave the lead to PWM figuring they could do a better job than me. To my disappointment, they had no idea, anything about the product as it would relate to this situation. My product is a simple patented product and they didn't have a clue what they should say to this distributor who they suggested a license agreement to! That is when the distributor called me looking for answers because PWM didn't have the information that he was looking for! After that PWM couldn't perform enough the get the license agreement done and I ended up hiring an attorney for another almost $2400. to finish as the distributor was agitated with PWM! By this time I am agitated to put it lightly. I got NOTHING from PWM except to put the idea of a license agreement out to this distributor! As PWM would say that I got greedy is a lie they did not earn the first dollar they got and I certainly wasn't going to give them 20% of any royalties! Unfortunately what happened is, they got $14,250 that they never earned! And that is wrong.

One thing us small entities need is some professional advice on marketing to the masses. Most of us don't find the needed resources in time. Maybe USP&T could send information to first time patent holders where to go to get help or a list of who we can trust along with our legal rights with marketing solicitations.
