I received an unlawful notice of application for wage execution from this agency claiming that they will garnish 10% or 25% wages from an old creditor T-Mobile. The issue here is that I have been in good standing with T-Mobile for about 3 years and up until recently decided to switch over to AT&T. The remaining balance was only 315.00 for closing my account. Several months later I receive a certified letter from New Century Financial Services, Inc. claiming that an application is being made by the judgement creditor “New Century Financial Services, Inc.”, for a wage execution order claiming to garnish 10% to 25%.
This is absurd I have never received proper notification from any collection agency for this matter before escalating it to garnishing wages. The only letter received was the balance owed after closing my account with T-Mobile which was a month ago and currently waiting for my rebate card from AT&T to payoff the remaining balance of $315.00.
After doing some research I have discovered that New Century Financial Services, Inc is regularly represented by the debt collection law firm Pressler and Pressler, LLP. Both of these agencies are notorious violators of federal debt collection laws known as the Fair Debt Collection Practices Act (FDCPA) and is sued regular by consumers for these violations. They are known for using falsifying deceptive debt collection tactics. I am now trying to seek a defense debt lawyer to handle my case.
I'm being sued by a bank that can give me any information or tell me if I even have an account with them they laugh at me numerous times and I called refused to put me through to a supervisor I also called this century place and they're being sued by a ton of people for a legally obtaining information from a third-party debt collector so I'm not paying them they went to the county courthouse and now I'm going to call my lawyer to habe him subpoena all the information because they don't have any it's extremely wrong and this little office should be shut down immediately because they're not a law office they do scams to try to collect for a third-party individual and the legally not allowed to do that if you get a letter from these people do not pay even if you're being sued go to your lawyer mediately because I've never had a bank account with these people and they cannot prove that I did so even though they put a judgment against me I'm still going to call my lawyer to have it thrown out and when I contacted these people they were extremely rude the second I said I'm getting a lawyer because their scam artist
The artorneys Pressler and Pressler accepted an ilegal debt that has been discharge from my credit report more than 15 years since it was issue by the original creditor wich it was not the current New Century Financial services and the original account was paid off as a settlement anyway and what they allege is a packeted account which somehow wind up. However, they are suing me and want wage garnishment of my job earnings. As a result my job is about to take wages from me. It is outrageous this type of harrasment for less than one thousand dollars the attorneys want me to paid them for gasoline monies as result of traveling to court.
I have been harassed by these people. I don't understand how I can be sued as they are writing and telling me an that the judge ruled in there favor and I had no nowledge of no court date and was not there to defend my self. So now not only is they harassing me for money they claim I owe them they say I owe court fees for which I was not there to hear or see what was happening. Now they are still calling with harassing calls of contempt of court jail time and confiscating any thing of value I own. Also taking all to 90% of any wages I earn.
