Mental health housing foundation william bill isabell, in dual capacity as current or past president and / or executive director of mental health housing foundation, mhhf which owns and operates about 10 condos in our home owners association, Hoa), and as hoa president, senior hoa board members tony bill halstead, hoa treasurer and/or marsha murphy, hoa secretary, had violated hoa governing documents, local and state laws to shield mental health housing foundation at the expense of the hoa and other hoa owners concealment of material facts, failure to disclose to hoa owners critical information pertinent to or negatively affecting their property, value, funds and/or falsifying ledgers or events about negative incidents caused by mental health housing foundation, mhhf, to frame and shift responsibility and accountability from mhhf to other owners and/or the hoa.

To most owners at our hoa, their ownership represents the most valuable investment, their nest egg. It is important for these owners to have the peace of mind that their investment and community is managed wisely. The most important three elements in real estate are: location, location and location.

We are fortunate to have a community that has many positive features such as great waterfront location with clubhouse, pool and within easy walk to shopping & transportation. Yet, the value of our condos is sadly lower than other comps that do not even have such amenities.

What could be the cause and what can we do to improve our community? I will share few concerns, key incidents, opinions, raise questions and offer suggestions of desperately needed corrections before they become major problems that may cost us dearly.

I have known bill isabell for close to two decades as a fellow hoa board member. For as many years, he served as hoa president. I thought that bill isabell was an intelligent administrator, was charming, disarming and presented himself well and i often supported him on many important board decisions based on what i now realize were selective and prejudiced information. Sadly such facade began to tarnish when i started to question some of his actions or lack thereof starting in mid 2016.

Mr. Isabell have serious conflict of interest. He had been using his authority as hoa president to advance his main agenda for mhhf’s benefit at the expense others.

Mental health housing foundation negative impact on our hoa and community:

While helping the a few mentally ill and homeless people is noble cause, that should not be at the expense, discomfort, endangerment and or loss of home value of hundreds of other unsuspecting owners and residents in the affected community.

For over 15 years, mhhf provided housing in ten +/- condos to mentally ill and homeless persons via governments’ subsidies. There were many instances where repairs were made to mhhf condos that appeared to be made at the expense of the hoa.

Further, rumors abound about numerous incidents that negatively impacted our community’s safety, security and or caused physical property damage.

Two former hoa managers as well as some residents felt threatened, feared for their life and safety. In one incident, a mhhf resident went into the hoa’s manager’s office in the clubhouse and locked the door deadbolt behind him and proceeded to close the window shades. The manager, sensed danger, feared for her life, ran out of the office thru a second door, downstairs to basement and escaped the clubhouse thru a side door. Even when the manager reported the incident to bill isabell, he relocated that mhhf resident from one unit to another unit in different building that mhhf also owns, still in the same hoa! shortly thereafter, the manager quit.

Another mental health resident, who believed he talked to god, had strong prejudice against minorities including blacks, jews, hispanics. He threatened the life of former manager and other residents. On another incident, mhhf resident wanted to commit suicide by placing his head in the stove oven.

Other owners and residents experienced physical damage, mostly flooding to their condos apparently due to abuse of fixtures or rough handling of facilities by mhhf residents/tenants. Even when water damage is reported, bill isabell took actions including abuse his power as hoa president to shield mhhf from accountability and defelect to other unsuspecting parties.

Guests of some mhhf residents loitered around. There had been increased incidents of vandalism, break in and sleep in laundry rooms or stair landings. Any of these incidents could have ended up badly.

Most hoa owners and residents are not aware that mental health housing foundation is operating ten condos in their hoa to house mentally ill patients. Bill isabell in his capacity as hoa president succeeded to conceal such information from hoa members.

I, for one, tried for several years, even when i was an hoa board member, to get a copy of hoa membersip mailing list, that we, as hoa members, are entitled to so i can share my concerns with fellow members. To date, hoa failed to provide it using lame excuses.

Hoa guidelines require potential tenants / residents to pass background check. Hoa owners complied with these guidelines. Yet, mhhf applicants who would otherwise fail the credit and or background screening process were quietly or secretly approved.

What is it going to take before the board and or the owners take proactive measures to remove negative factor to protect hoa from such negative exposure? Are they waiting until there is major damage, injury or loss of life that will make front page news before they get their wake up call? By then, it will be too late.

To be fair, not all negative incidents were caused by mhhf, but significant disproportionate ratio where mhhf was a major contributor. We learned about some of these incidents from others who live in or are familiar with the hoa. We, hoa owners and/or residents are owed from mhhf and bill isabell detailed description about each such incident that negatively impacted our hoa, owners and community. We requested for mhhf and hoa such disclosure, but both the hoa and mhhf evaded and failed to provide. And where they were compelled to respond, they gave false, misleading and or fraudulent information.

Conceal critical facts, fraudulent actions & failure mhhf to abide by hoa guidelines:

Mr. Isabell repeatedly failed to disclose to hoa members negative activity and incidents that was caused by mental health housing foundation residents. Further, he allowed fraudulent activity in efforts to conceal and cover up mhhf misdeeds and violations. In the process, mhhf and mr. Isabell subjected the hoa, its members and residents to serious negative exposure that appear to have compromised and threatened our hoa’s community safety and financial wellbeing.

I consider mhhf is in violation of our hoa governing documents and applicable laws. Owners are owed full transparency and accountability starting with documentation of all incidents that took place at our hoa and what was done to remedy them. The owners need to know all facts and given choices to have their voices heard in order to make most informed decisions in the best interest of our hoa community.

My understanding is bill isabell plans to retire and have a new person from mhhf serve on the hoa board so he can continue to wield his influence from the sideline.

Apparent violations include conspiracy, fraud, misrepresentations, falsification of records, concealment of material facts, bearing false witness, cover up, fabricated false data to shift accountability away from themselves, falsely and fraudulently accuse and frame other unsuspecting owners as scapegoats and failure to account for missing or lost hoa funds and hoa bank account.

Fdic investigation and their report confirmed that hoa received all hoa dues in question that hoa claimed it did not receive from me and provided copies of monthly deposits into hoa heritage bank account ending in 6155.

Fdic report mirrors the data i already provided to the hoa over the last two + years.

Fdic report supports that senior hoa board members bill isabell as hoa president, tony bill halstead, hoa treasurer and/or marsha murphy, hoa secretary abused their power, conspired with hoa manager dave wescott and fabricated false data to cover up the apparent embezzlement or disappearance of thousands of dollars in hoa funds and hoa bank account.

Even after i provided hoa board and management with a copy of fdic report and a copy of hoa heritage bank statement showing that i timely paid my hoa dues in full. I urged the board to correct the damage they caused by removing the fraudulent liens on my property, do proper accounting to credit me with the payments i made to hoa as confirmed by fdic, and reverse thousands of dollars in fraudulent late fees. The hoa board did not respond or make any corrective effort .

In recent communications to the hoa board and management, i asked them to provide me names and contact information of current hoa board members. Again, no response from hoa board.

Failure of the board of directors of mental health housing foundation and our hoa to correct their misdeeds, in my opinion, is tantamount to willful cover up that is again is subjecting all involved, individually and collectively, to greater exposure and liabilities.
