I was cold called by a person on Tom Hennery Staff, as it sounded shady, I started dealing with Tom the Sales Manager. Email following… On October 16th, Tom said they would produce my web page views 1040 times which is defined by 7 consecutive days as one time. (See Exhibit A). Tom communicated over the phone it was done in 14 days. On Day 15 I was not on all three search engines they were concentrating on, especially the 12 other ones. I had two out of twenty phrases on Google, that’s it. One site. It counts as 2 of 1040. I offered to pay 10%, they refused so I reached out to Tom and Deborah five times, see emails (Exhibit B to Deborah and Exhibit C to Tom). They ignored some and returned two.

I then receive a phone call telling me “we will win the dispute we always do, for sure we will win so protect your credit and make it right, pay the bill to keep your credit good” but I am sure most people who were scammed didn’t ask for an email in writing to supersede the agreement. See definition of Supersede on next page. I have saved to my voice mail to produce but I can’t figure out how to copy and send it. Still working with Apple.

Tom sent an email on October 20th, because I was skeptical due to no information on the BBB. This was four days after being pressured. He said it would be focus on the three main search engines and the 1040 touches would happen(Exhibit B). It hasn’t happened in 14 days nor has it happen in the 45 days since then. If you look at the Letter from Tom Hennery on October 20th, you will see much more detail than in the contract (Exhibit B). The contract is how the beat the credit card companies. You can see that the math of getting the contract fulfilled is impossible now that they have not provided the service for two months. There is only 4 months remaining to get my 1040 on the three sites as Tom and Deborah put in writing. Before that Deborah Kimble guaranteed if the first page placements don’t happen she said I “will be refunded $3690.” This company is a fraud, (see Exhibit E) Deborah uses “outweighs”, I’m sure after the phone call they wanted to wait 6 months so I could not claim a dispute but instead I claimed a dispute on day 15. When I questioned Tom and asked him to call he ignored my request to resolve two times see (Exhibit B) now they tried ripping me off. I was concerned day 4 and wanted out day 15 when the service was not provided. Now 60 days later makes it impossible to honor their obligation. See Tom’s email (Exhibit B). See Exhibit D for Details on the request to Terminate that went ignored.

((REDACTED BASED ON FINDINGS VIA COURT ORDER)). ((REDACTED BASED ON FINDINGS VIA COURT ORDER)). Joshua Stern is far more concerned with his pocket, maintaining a good relationship with other agents & his gigantic ego that he is steering clients to whatever deal makes most sense for him. How can Joshua Stern fighting for the best deal, when he has to maintain a good relationship with all the agents? He can't , so instead of fighting for you the client, ((REDACTED BASED ON FINDINGS VIA COURT ORDER)). ((REDACTED BASED ON FINDINGS VIA COURT ORDER))!!!

Martha Greenleaf failed to disclose defective KITEC Plumbing which was recalled by the manufacturer in 2005 and SKY View Homes, through their subcontractor Big M Plumbing, continued using the defective KITEC Plumbing in SKY VIEW /Scott Patrick built homes in Mariposa, Rio Rancho and in Aluquerque Anadalucia De La Luz in 2006 - 2007. The defective KITEC Plumbing fitting (crimped) to Kitec pipes were disintegrating and the pipes bulging and cracking and eventually bursting within 8-10 years after installation (sometimes sooer), cauing major water damages some as much as $90K) and $40K to $50K re-piping bills.

I have been an agent for 15 years. I have had several unsavory brokers however this company does not get a clue. They did not honor my independent contractor agreement as an agent or a contractor. It resulted a loss of sveral thousands of dollars. I would not trust any agreements this brokerage enters you into. I have an email chain that goes to broker proving they approve agents to sign your name as a consumer to contracts. When I called them out on this is when they took all my work from me.

Tom Grisak is one of the most pompous, arrogant, and most unethical people I know. He was so mad when I made the decision to list with an outside agency that he blasted me to several people in the area, sent me a mean-spirited email, and made threats that he would make sure no one at his office would show my listing.

He said because he spends so much money on marketing that he should be the only go-to Realtor for the area. What an arrogant statement. I live in Lucas and I learned after my experience with him that I'm not the only person to have issues.

Tom wanted to fly a drone over my property for his website. I asked if he was aware of the new laws (former aviator) and he joked, "no one will notice and it'll take no more than 10 minutes." I was flabbergasted and insulted. I was part of FAA guidelines all throughout my career and here was this man telling me he 'cheats' so he could get a good flyover picture. This man knows we have an airport nearby. If he's willing to cheat on this small item then what else does he cheat on? As a former naval pilot and longtime AA pilot I was totally shocked at this man's character. Is this how he wins so much business? By cheating?

The day Tom saw my sign go in the yard it was as if he was stalking me. He called me within 2 hours of that sign being placed. I learned from my Realtor that he was violating the code of ethics by calling another person's signed client.

Then I got an email and forwarded it to my Realtor. She asked Tom to please not contact me and he denied sending anything or calling. He then called her a liar and attacked her character.

My house closed so I wanted to share my experience with others. This man should be avoided at all costs.

Melanie Hyer was called in on my divorce case and was recommended by my ex-husband's attorney Maria Gonzalez with Young, Berman, Karf & Gonzales. Her speciality was outlined as Probate issues. From the first communications I had with Melanie she indicated she was hired to work on both sides equally and get the house sold quickly. This was never the case!

She organized a removal of personal property on my ex-husband's side and he was to remove only items from the garage area of my home. Melanie let him remove pictures, empty a a stereo cabinet and route through my kitchen cabinets for knives within the inside of my home. When I confronted her upon my arrival, Melanie said she would remove me from my home next if i don't cooperate.

Melanie got my home drastically reduced by filing with the courts her recommendation based on a year old house evaluation report and comparisons on un-renovated properties. Along with what her guess at would be a maximum search amount. These recommendations where all done without her stepping on to my property and her base of operation is 50 miles away. Melanie turned down a sellers credit that was previously negotiated.

When an offer was presented and the inspection was concluded Melanie had no negotiation skills and recommended to sign off on a $10,000 credit for repairs. Repairs included $5,000 for a new AC unit which was working and inspection report indicated the unit should have an expert check it out to get a true evaluation. $3,600 to repair the roof, which I provided a proffessional quote for $850.00.

Melanie, was very unprofessional and never provided her contact phone number, her rate she was charging until I asked. When i did call her or spoke to her in person she was always rude, threating and talked over me. There was a walk-through by the buyer scheduled Melanie failed to show up and cancelled the court approved walk-through.

In the end I had to pay Melanie Hyer $3,500 for her services with a check that was issued to her personally and not to Keller Willaims Reality which is her employer. There was no benifit from using her services.

I will be taking up this matter when I find out who Melanie Hyer reports to and she is reprimanded for her actions. I would never recommend Melanie Hyer or the Keller Williams Reality Group.
