Iowa Department of Human Services Reviews

  • May 27, 2016

Iowa held no jurisdiction over me to place a lein on SSDI, but passed through the loophole as I reccieved my first checks which were SSR. Federal law prohibits the SSDI from incomberment and it superceeds the SSR, which can be garnished when it exceeds the SSDI is my interrpertation of the rule. Yet this is not the case in several states.

This goes back even further to argue Jurisdiction as the original order was made in the Commonwealth of Pennsylvania ands by the rules should have been transfered to Texas, when it was discovered that I had relocated. While it was investigated in 2003? The Texas reciprocasting agency refused to pick up the case for whatever cause which could have been school or disability. I will go further to state I never domiciled outside of Pennsylvania from 1969 till 1996 when I came to Texas excluding trips to Iowa on the custody mattter and in 75 on a trip to Los Angeles to visit family. If Texas refused the case it is self evident that there was an issue of State Rights and/or my personal finance.

When I was called to a contempt hearing in Pennsylvania nearly 2 months after the termination hearing the case was dismissed in the Monroe County Court the same district as Pike County in which the order originated, I had moved by that time due to Delawar Watergap National Recreation Area rule of eminant domaine, I suspect Texas procured and entered unofficial judgement to refuse the case. With this dismissal the order for support ceases to exist, at least theoretically.

Issue #3 the mother was incompetant to adiquatly care for the child, as she and her parents testified to when my parental rights were terminated. I have every reason to believe that some of the testimony was nearly repeated 2 months later when the mothers rights were terminated, in what I believe to be in abstencia. Lorrie the mother was living in Des Moins, and the hearing took place in Ida County and would have been dependant on her parents for transportation. The child lived under supervised care of a sisterr or grandparrent at all times thus did not need the financial support of the mother, which used the money as a personal allotment very little of it went for the child. At least that was the way before she left my domicile, as I attempted to haave her spend down on asertaing the needs of the child in her last trimester. The effort further astraied us from companionship as I was getting more intense on essential repairs to the house, and didn't want to realize the slow oncomming of disfunctionality.

What do you need from me as I doubt I have any hard evidance as I felt as if I was "beating a dead horse" discarding most of the papers a couple years back. However I believe I can recall most of the months and actions which took place that would support my case. From there we would have to retrace the documents. Having PTSD is no fun.
