By way of background, we purchased a 2015 Nissan Rogue from Garden City Nissan on or about 10/27/2014. When purchasing the car, we bought a 7 year Golden Warranty for an additional $3,000 which we were advised was a “wire to wire” warranty covering all issues with the car for the next 7 years.

Our problems first started on or about August 2018. We first noticed water dripping from the right hand side sun visor on the front side. Then we noticed water dripping from the interior, overhead, front passenger lights.

In the end of August, I became ill and needed surgery so did not use the vehicle for about 2 weeks. The car remained in our driveway. When we went back to use the vehicle and it smelled horrible and we could see mold growing on the front and backseat carpets.

We called Garden City Nissan in the beginning of September but had to wait until on or about 9/17/2018 to take the care in as they did not have an appointment available before then.

Garden City Nissan initially kept the car for diagnosis purposes and refused to give us a loaner while they determine what caused the problem. After 2 days, a Garden City Nissan associate, Mr. Shawn Nathu, called us and advised us to contact our insurance because they needed to replace the carpets and airbags and fix the problem.

The main problem, as determined by Garden City Nissan, was a water leak into the car. However, they never determined where the water was leaking in from. Mr. Nathu initially claimed the leak was our fault because we somehow caused a drainage issue and that is why we needed to contact our insurance. However, when we requested proof as to how it was our fault & how we contributed to the leak, he offered no further information or evidence. Moreover, he was very rude and disrespectful in dealing with us.

Mr. Nathu advised it would cost approximately $4000 to fix the problem and that is how much we should claim from our insurance. We believe this problem was caused by faulty manufacturing but he refused to honor the Golden warranty we had purchased.

Frustrated, we reached out to Nissan HQ in Tennessee & spoke with a customer service agent named Ms. Hanna. Within 2 days Ms. Hanna called us back and informed us that Nissan would cover the cost of repair & she would coordinate this with Garden City Nissan. Ms. Hanna also advised they would provide a rental for 5 days as per the Golden Warranty.

Subsequently, she called back and advised Garden City Nissan refused to remedy the problem unless we paid 20% of the costs. Unwillingly, we agreed to pay as we had no loaner and no other option to get our car back. Garden City Nissan kept the car for over 5 weeks while all this was being resolved.

For the entire 5 week duration, Garden City Nissan refused to provide a loaner vehicle or even partial reimbursement if we wanted to obtain a loaner independently.

Having agreed to pay approximately $800 for the repair or vehicle, the vehicle wasn’t returned in a satisfactory condition with mold still present on mats. The mats were thrown into the trunk of the vehicle. The mats were not cleaned or replaced. When we complained about this, Mr. Nathu advised we would have to purchase new mats – on top of e $800 we have already spent getting the car fixed. So in addition to returning moldy mats, they further spread the mold into the trunk of the car by haphazardly leaving them there for the entire time!

In addition, we were supposed to get all oil changes free of charge for the next 7 years as per the warranty agreement, but now we are forced to pay for oil changes because we were advised the dealership no longer wants to honor any previously issued warranties.

If Nissan does not want to honor the warranty they sold to us, we would like a refund of our $3000. Moreover, we believe we should be refunded the approximately $800 we have just spent as it should have been covered by the warranty.

We ask for your help with this matter. We are both elderly people, both over 70 years of age, with serious health issues – which is why we had purchased the Golden Warranty with full coverage. We were hoping for a worry free for next 7 years but we were harassed and forced to pay approximately $800 to get our car back & now may have to pay more to correct the mold problem in the trunk.
