General contractor fees and charges will only be included in the estimated reasonable replacement costs if it is reasonably likely that the services of a general contractor will be required to manage, supervise and coordinate the repairs. However, actual cash value settlements will not include estimated general contractor fees or charges for general contractor’s services unless and until you actually incur and pay such fees and charges, unless the law of your state requires that such fees and charges be paid with the actual cash value settlement.

I see two major issues with this clause. First, and perhaps most obvious, is the language that makes the decision to pay overhead and profit subjective. While the traditional view is that overhead and profit will be paid if three or more trades are involved in the repair, this policy states that overhead and profit will only be paid “if it is reasonably likely that the services of a general contractor will be required to manage, supervise and coordinate the repairs” (emphasis added). The insurance carrier will be the one to determine if a general contractor is necessary regardless of the number of trades or complexity of the work to be performed. I can only imagine the fights this will cause.

The second major problem with this clause: overhead and profit is only paid once incurred by the insured. Making overhead and profit an incurred coverage item can put a huge burden on an insured that may not have the means to front the expense. Imagine a homeowner has a fire that destroys their home. The replacement cost of the home is $200,000 and after overhead and profit is added the total rebuild cost is then $240,000. However, the home is older and the insurance carrier depreciates the home by $50,000 making an actual cash value payment of $150,000. In that instance, Farmers would write a check for $150,000 for a $240,000 loss. The insured can’t make a claim for the recoverable depreciation or overhead and profit until those costs are incurred. The insured would have to front $90,000 to secure full indemnification under the policy.

Finally, it should be noted that the policy form this clause was taken from is the one used by Farmers in Pennsylvania. I wonder why this provision is even in the policy as it states that overhead and profit will only be paid when incurred, “unless the law of your state requires that such fees and charges be paid with the actual cash value settlement.” As my learned colleague, Larry Bache, wrote in October, 2012, Pennsylvania law requires overhead and profit to be paid as part of the actual cash value payment. However, after conversations with some folks working claims in Pennsylvania, that does not seem to be how the claims are being administered.

If you have been following this series, you may be noticing a trend, the policy seems to have a lot more words and a lot less coverage. Reading it, I feel like I am entering the Twilight Zone.

I purchased 3 policies from this agent and paid all of the premiums in full in advance, however every month thereafter I received an invoice in the mail. When I queried Burt Harris he told me to just ignore them which I did.

Three months after my poicies had expired and I had placed my policies with another agent I received in the mail two notices from Credit Collection Services regarding Farmers Insurance Group , both marked past due and with this statement "Please be advised, failure to satisfy your credit obligations may resultin adverse credit information being reported to a Credit Bureau.

This could have a negitive effect on your ability to obtain a future loan and/or negotiate favorable credit terms with your business partners" I called Burt Harris and pointed out that I had paid the entire premimum in advance and asked that he contact the Collection Service, inform them that I had paid in full in advance and send me a letter for my records that stated that I did not owe any money to Farmers Insurance.

Today. August 26 is three weeks since I received the collection notices and I still have not received that which I requested including proof of prior payment.

No one wants their credit inpuned and I have received nothing from Mr. Harris that informs me that the collection action has been dismissed.

Would anybody want to do business with someone like this?

Payed about $300 a year for a policy to cover damage, theft and fire coverage to a mobile home for 20 years. we filed a claim to cover repairs to the roof . they sent this idiot out that really did not know what they were talkin about. a few hours later the claim was denied. so i cancelled the policy. as far as we are concerned insurance through this compay is nothing more than a big rip off. i don't think we can even recoup our money back. this was a year ago.

Stay away from Farmers Insurance, and spread the word about them. Help spare other people from going through a Farmers-Insurance-generated HELL.

Farmers Insurance - a sad and sorry big-corp full of soul-less agents who have no respect for human life - offered $200, TOTAL, for my pain. That’s right, $200. Total.

Even now, Farmers Insurance continues to withhold fair and reasonable financial compensation after 15 long, EXHAUSTING, pain-filled months since my October 2, 2017 car accident. For 15 months I have had to muster up energy that was supposed to be spent healing, to, instead, continuously battle Farmers Insurance for proper medical treatment, medical debts, a car upgrade, and other losses.

Farmers Insurance’s soul-less Agent, Aelicia Leyva, employed at 1190 Saratoga Ave. in San Jose, CA, ignored my pain, plus my 5 – count ‘em, 5 MRIs!!! Aelicia ignored my Osteoporosis, a first-ever partially dislocated right shoulder, plus the first-ever lump that surfaced in January 2018, which I feared might be cancer.

Farmers Insurance continues to delay issuing a fair and reasonable settlement, in part, due to its unwillingness to cover a measly $1,087 for the value of my old but still well-functioning trusty chariot! --- Yes, just $1,087.

Farmers Insurance Agents generate road block after road block over much time expecting you to quit and give up on justice. Do not give up until justice is served!

Farmers Insurance has been selling fraudulent classic car insurance for the last 25 years. Farmers doesnt't have a single experienced classic car appraiser on staff. Farmers doesnt't have a single classic car parts locator on staff. Farmers doesn't have a single classic car collision shop in Southern California where there are a 1,000 cllision shops. Farmers computer software only goes back to 1976. The Farmers adjusters are total amaturs at adjusting classic cars. Buy your classic car insurance from a company that specializes in classic car insurance.

When my Farmers policy expired, I insured my home, autos through a competitor. Farmers continued to bill me, and I was told that I had to show proof of insurance in order for them to stop. Although it was none of their business, I did supply proof that I had coverage through a different carrier. Then the threats to from their collection agency began to come, warning me me that they were attempting to collect a debt. Of course I didn't want my credit to be damaged and I wanted the "Warning" notices from the credit collection agency to stop. I called my agent, and he offered to pay. I wouldn't have it - I didn't owe them anything! After months of tedious calls and waiting on hold, Farmers finally stopped trying to steal from me and dropped the issue.

Has anyone else had a problem with Farmers Insurance, in Las Vegas, Nevada, when it comes to workers' compensation claims? I know someone who got injured/electricuted (480 volts) on the job, and had to have a few surgeries. Farmers Insurance has both delayed bi-weekly payments and/or has only paid 1/2 of what they should be paying. It is interesting that Farmers Ins. airs tv commercials of how they say they pay on claims. The truth is they either don't, they only pay half, or they extremely delay payments.

Based on the catchy advertising we see on television, you would think Farmers Insurance is a warm friendly, trustworthy insurance company. They are not! Farmers Insurance is not a reputable company.

Their claims associates and management team cannot be trusted to deal with damaged parties in a fair and equitable manner. Based on my experience with them, I believe that Farmers has instituted policies that place damaged parties in a no win position. Farmers only concern is to settle claims in the least costly manner as is possible. They are not concerned in returning damaged parties to the same position they were prior them being harmed by a Farmer’s policy holder.

Farmers sent me a check to repair my car that is 40% less than any repair estimate I have received here in the Franklin, TN area. The Farmers damage estimator told me “don’t be mad and yell at me” when she handed me the Farmers repair estimate. This includes estimates from Farmers handpicked shops. Farmers told me they are not responsible for the lost value that my car has taken because of the accident. Farmers has told me that my cars value has not been negatively impacted by the accident based on the fact the accident has not yet shown up on Carfax. Farmer’s claims representatives will not return calls or answer emails. They even told me to call the insured if I am concerned about my cars lost value. How would you like to be a Farmers policyholder who receives a call from someone you hit in an accident?

Pray you are never in an accident caused by a person who has Farmers Insurance!

BEWARE!!! ZACHARY WALSH FARMERS INSURANCE. this location is terrible the Agent Zach Walsh is MEAN, RUD and need to be retrained, am suprised how this location is open. I request home insurance and Kim contact me regarding my request for my homowners insurance in 7/18/17, very nice person we schedule in appointment for 7/19/17 at 2:30Pm. this Agent contact me two hours later very unprofessional. I give him my information of my house and he tell me that he give me a call later or the following day, he never contact me and after 3 days I call him and he was very Mean and rud he said to me that he was very busy and he wasn't interested in my business. any other people looking for his service please read this and don't contact this Agent Zach Walsh I hope farmers can read this and fire this Agent and hire better Agents.

From what I can tell, I don't see that you live in my state in which I am only licensed for business here. Van Carlson, owner of Van Carlson Insurance Agency, a Farmer's Insurance company located in Meridian Idaho, is also one of the owners and investors of a company that I built a website for. The business is c/alled Capellan International or Vanity Vapes. Most recently it's gone from Capellan International to Vanity Vapes LLC to Vanity Vapes Inc to the current VanityVapes.com.

I built a website for Vanity Vapes, but unfortunately am still owed $18K for services rendered. It all came to an abrubt halt when they were evicted from their office in Boise for not paying rent or utilities. This left 30+ employees out of jobs without being paid for nearly 6 weeks.

On top of that, other business tactics included withholding deductions from employees paychecks for medicare/medicaid, social security, as well as federal and state taxes. Admittedly by CEO Elvis Capellan, this company is worth millions of dollars and has done millions of dollars in sales, but oddly enough, they haven't paid any Sales Tax to the Idaho State Tax Commission for the nearly $154,000.00 in sales tax that they owe if their sales figures are accurate.

What is VanityVapes.com?

It is a company that sells personal vaporizers, or more commonly known as E-Cigarettes, Electronic Cigarettes or "Vapes", hence the name Vanity Vapes. Essentially it is flavored liquid that is heated and in turned into vapor, then ingested, giving the user the nicotine fix that they want without the smoke.

Unfortunately, at the point where I no longer wanted to have anything to do with this company was when I found out that their main business focus was to have fruit and candy flavors so they could entice junior high and high school kids into purchasing their products. They engaged in telemarketing to these children right after school got out and before parents would get home.

At one point, the decided to run an advertising campaign on tv and radio in the tri-state area around Ohio since the laws in those state don't prohibit children from purchasing "vaping" products. As Elvis Capellan told me, we will make almost $10 million dollars this year alone. After discovering what they were doing, I called him out on it and told him that I couldn't have anything to do with what they were doing because it was illegal and wrong. It was the next day when he was evicted from his Boise office and moved it into his garage in Nampa, Idaho.

After talking to Van Carlson about what was going on, he seemed to be concerned on the phone, but it had been explained to me that the investors were behind the marketing strategies, even bringing in a marketing consultant to make the business more lucrative and profitable.

If Van Carlson supports Vanity Vapes with those kind of morals, values and business ethics, what about his other businesses like Van Carlson Insurance Agency and any other companies that he owns/has invested in.

Farmers Insurance Company cheats customers. I was robbed, shot and left to die by starvation after a robbery in a freezing -43 below zero home. This company failed completely to investigate after my 911 call and police report, failed to compensate one single loss of my renter's policy. My policy was only enough to start over, not to cover the massive losses, pain and suffering, or trauma myself and family have endured because of the failure this company and the deceptive practices they have in paying claims.

On Sept 5, 2015 my new 2015 Nissan Frontier Truck ( with approximately 2,000 miles) was rear ended by a Ford

dump truck. The gentleman has Farmers Insurance. My collison man wants to replace thebumper & tail gate.

His estimate is $2500. Farmers Insurance refuses to replace the tail gate & wants it repaired. The difference

between a new tail gate & the repair is $300. I have had vechiles which were repaired & in 3-5 years they rust.

I plan on keeping this truck & I am entitled to proper repair. I am filing complaints with Insurance Commision

& Attorney Generals in both Ohio & California. There was never a person from Farmers Insurance to look at the

damage. They took the estimate from my collison company & deducted $300. They did there estimate from

pictures that were sent to them.
