Brick Mortar Rentals is what the name should dtand for...They built a patio with a fireplace, pool, and outdoor kitchen on my house back in 2006. Little did I know when I purchased the house from the owners that the outdoor fireplace and kitchen would fall apart and become a safety and liability issue in less than 10 years of construction.

The fireplace was not built on a proper foundation, or tied into the foundation of the paio and has separated from the structure and leaned back more than 6 inches because the foundation is sinking.

I had one of the owners of BMR, Mike, come out and check the issues and he commented that he wasn't sure why they still built fireplace structures because they always seem to have foundation issues with them. I then contacted 7 different foundation comapnies to quote on repairsand 3 of the companies would not even provide a quote out of concern for their crew's safety.

I then had another BMR owner, Rick, out to see the issues and without hesitation he said they needed to get this handled quickly because if it falls it would be an insurance company field day with lawsuits for everyone. (I agree) He then arranged for a crew to come out the next day and demo the top 6 ft of the fireplace stack to limit the immediate safety and liability issues. Nothing like 3 tons of stone leaning backwards into your neighbors yard and where your kids play.

My expectation was that after the demo of the stack we would make a decision on how to stabilize the foundationa and make the needed repairs to the fireplace.

Then much to my surprise, Rick stated that it wasn't under warranty and they were just trying to do me a favor and that we have nothing more to talk about. Funny how the discussion changed after the liability and saftey concerns were mitigated.

A favor like charging $10k for a disposable fireplace that can't be used and now not having the integrity and conscience to stand by your work and do the right thing...amazing. I guess he thought it was a good business decision to pay 2 laborers a minimal hourly rate to demo the stack, eliminate the liability issues, and then part ways...

After I started going public with the issues, they tried to hide behind the fact that I am not the original owner of the house and did not contract with them directly. And then tried to say that they can't control the weather in texas and they have no idea how to strucutre was taken care of...

I always thought a permanent structure was supposed to be engineered with consideration to the weather, soil type, and heat. I guess BMR isn't familiar with that process. If the structure was engineered correctly in the first place there would be no reason to worry about who they contracted with. I guess they count on people selling their homes to help limit their liability exposure.

The foundation supporting the kitchen is sinking as well and can't support the weight of the stone. It has pulled away from the house and is 2 inches below the original build height and still moving.

Unfortunately I started looking at online reviews and dissatisfaction with BMR isn't an uncommon occurrance.
