My experience with Blue Fox Properties LLC. Keep reading, I am suing them.

On 10/22/22 I legally terminated the contract with this company as my family and I were tired of the condescending and unfair treatment from management. As per the contract, I paid the amount of $3890.00 USD to terminate it. I turned the keys in to the company a day prior, on 10/21/22. As per our legal contract “Landlord/Agent will provide an accounting and any refund due of the security deposit within fourteen (14) business days of Tenant’s termination or expiration of this agreement, return of possession and demand by Tenant.” I did not receive a response from them until 12/02/22 which is 30 business days (41 days) later and a violation of their own contract.

I also requested to be present for the final inspection but the company failed to notify me when it would be done. As per our legal contract “Tenant may request to be present during the move-out evaluation.”

In the final letter Blue Fox Properties sent me on 12/02/22 they added a list of fees that they subtracted from the security deposit and ledger balance. The security deposit was for $1495.00 USD and the ledger balance was for $69.52 USD, totaling $1564.52 USD. Below I will explain each of these fees:

Replace batteries in all smoke detectors // 45.00 USD // Tenant response: All smoke detectors were working properly until move out day. According to the Security Deposit Disposition form you sent me, your inspection was completed on 11/15/22 which is 24 days after moving out. According to our contract, you legally needed to complete the final inspection within 14 business days which would have been by 11/10/22. Batteries can run out in 24 days.

Clean dryer vent // $85.00 USD // Tenant response: To clarify we had our own washer and dryer which we took with us. A dryer vent is a tube that runs from the clothes dryer to the exterior of the home or building. The contract does not mention anything about a dryer vent, therefore is another example of the unnecessary fees you have charged us.

Replace burned out light bulbs 8 bulbs 3 frosted // $85.00 USD // Tenant response: All light bulbs were fully functional by move out date. According to the Security Deposit Disposition form you sent me, your inspection was completed on 11/15/22 which is 24 days after moving out. According to our contract, you legally needed to complete the final inspection within 14 business days which would have been by 11/10/22.

Replace broken light panel in kitchen // $65.00 USD // Tenant response: The light panel was broken when we moved in. If I had known this was going to be an issue, I would have reported it. This is a rental property therefore it is common sense that property already had normal wear and tear.

Tighten door knobs // $45.00 USD // Tenant response: This one is just, SERIOUSLY???. There were no problems with the door knobs. The contract does not mention anything about door knobs. According to the Security Deposit Disposition form you sent me, your inspection was completed on 11/15/22 which is 24 days after moving out. According to our contract, you legally needed to complete the final inspection within 14 business days which would have been by 11/10/22.

Replace missing toilet paper holder // $15.00 USD // Tenant response: Only the ‘roller’ was missing from the second bathroom not the entire toilet paper holder. I can’t remember if that was there when we moved in. Noted.

Touch up paint // $95.00 USD // This is a rental property therefore it is common sense that property already had normal wear and tear. Blue Fox Properties certainly did not install everything/anything brand new for us upon moving in. I mean, you didn't even paint the walls! We returned the property clean and I have the pictures to prove it.

Repair drawers in master bathroom and kitchen // $ 110.00 USD // Tenant response: All drawers were fully functional, I know because I cleaned them myself before returning the property. They do squeak a lot, you should add some grease on the rails.

Patch nail holes throughout // $ 150.00 USD // Tenant response: I did patch them myself. I am unsure why you are lying about this. I have pictures and videos to prove it.

Re-screen patio slider // $95.00 USD // Tenant response: The patio slider screen was working just fine. I am unsure why there was a need to re-screen it. This seems like a homeowner preference/expense. According to the Security Deposit Disposition form you sent me, your inspection was completed on 11/15/22 which is 24 days after moving out. According to our contract, you legally needed to complete the final inspection within 14 business days which would have been by 11/10/22.

Repair window frame in master // $110.00 USD // Tenant response: I am a little speechless with this one. You are charging me for structural/building damages? I also have no idea what the concern with this one is.

Paint chipped brick in carport // $85.00 USD // Tenant response: I have no clue which chipped brick you are talking about. But again, you are charging me for structural/building damages?

In addition, they also sent me an invoice for landscaping services that were completed 11/28/22. The invoice was for $340.00 USD. Keep in mind that this was 37 days after I moved out. Weeds don't grow in 37 days? The wind does not bring any debris to the property in 37 days?

They also sent me another invoice for $99.00 USD for carpet cleaning. I hired Steamy Concepts, the carpet cleaning business you advised me to hire.They cleaned the carpets at the property on 10/21/22. Please see attached receipt.

They also charged me an additional $155.40 USD cleaning fee. Tenant response: As I had mentioned above, I cleaned the property before turning in the keys and I have the pictures to prove it.

I have attempted to serve the defendant Blue Fox Properties LLC by ‘Certified Mail, Return Receipt’ and USPS has left multiple notices of attempted delivery but Blue Fox Properties management does not want to be served as they keep hiding/ignoring me, USPS and the law. The tracking number for the Certified Mail letter is 7022 1670 0003 2572 1858, these details can be confirmed on www.usps.com. I believe they have no intention of being served. Now I have contacted the Constables at Pima County to serve the defendant through them instead.
